Im Gegensatz zu den meisten anderen Staaten der damaligen Zeit hatte das Deutsche Kaiserreich in seiner Verfassung von 1871 schon das allgemeine Maennerwahlrecht verankert (Art. 20). Eine Einfuehrung dieses Wahlrechts, das vom Norddeutschen Bund uebernommen wurde, beruhte auf innen- und aussenpolitischen Erwaegungen Bismarcks. Einmal lag es in seiner Absicht, das allgemeine Wahlrecht gegen das liberale Buergertum zu verwenden, vertraute er doch auf die Obrigkeitstreue und das konservative Beharrungsvermoegen der Landbevoelkerung; zum andern hatte Bismarck es propagiert, um die nationale Einigung voranzutreiben und Oesterreich aus Deutschland zu draengen.

In contrast to most other contemporary states, the German empire embodied a universal male franchise in its constitution of 1871 (Article 20). The introduction of this right to vote, which was adopted from the North German Federation, was based on Bismarck's calculations about domestic and foreign policy. At the time he intended to use the general franchise against the liberal middle classes, but he was counting on loyalty to the governing elite and the innate conservatism of the German people; Bismarck also aimed to promote national unity and to force Austria out of Germany.

§ 631. Vertragstypische Pflichten beim Werkvertrag
(1) Durch den Werkvertrag wird der Unternehmer zur Herstellung des versprochenen Werkes, der Besteller zur Entrichtung der vereinbarten Vergütung verpflichtet.
(2) Gegenstand des Werkvertrags kann sowohl die Herstellung oder Veränderung einer Sache als auch ein anderer durch Arbeit oder Dienstleistung herbeiführender Erfolg sein.
1. Kennzeichen des Werkvertrags. Der Werkvertrag ist durch die Pflicht des „Unternehmers“ (s zu diesem Begriff § 14 Rz 1) zur Herstellung des versprochenen Werkes charakterisiert (Abs 1). Der Werkvertrag ist also erfolgsbestimmt (Bsp: Schuhreparatur, Architektenvertrag, Beförderungsvertrag) während der Dienstvertrag (§ 611) tätigkeitsbezogen ist (Bsp: Behandlungsvertrag, weil der Arzt regelmäßig nur die sachgemäße Behandlung verspricht, nicht aber den Erfolg der Heilung). In Zweifelsfällen ist für die Abgrenzung der im Vertrag zum Ausdruck kommende Wille der Parteien maßgebend. Beispielweise können Forschungs- und Entwicklungsleistungen Gegenstand eines Dienstvertrags wie auch eines Werkvertrags sein; entscheidend ist, ob nach dem Vertrag eine Dienstleistung als solche, also ein den Regeln der Wissenschaft und Technik entsprechenden Vorgehen, geschuldet wird oder die Herbeiführung eines Erfolgs, also etwa ein bestimmtes Arbeitsergebnis oder die Anfertigung von Berichten (näher BGHZ 151, 330; zum Vertragsrecht der Dienstleistungen de lege ferenda Wendehorst AcP 2006, 205 279ff). Wird die Lieferung einer herzustellenden beweglichen Sache geschuldet, gilt gemäß § 651 grundsätzlich Kaufvertragsrecht, ggf einschließlich der Sonderregeln über den Verbrauchsgüterkauf (s im einzelnen § 651 Rz 1 ff), so daß das Anwendungsfeld des Werktragsrechts stark eingeschränkt ist (s § 651 Rz 4). Das herzustellende Werk kann, wie Abs 2 klarstellt, sowohl eine körperliche Sache als auch eine geistige, wissenschaftliche oder künstleriche Leistung sein.
2. Pflichten des Unternehmers. a) Abs 1 nennt als Hauptpflicht des Unternehmers die Herstellung des bestellten Werks. Hinzu kommt gemäß § 633 I die Pflicht des Unternehmers, dem Besteller das Werk frei von Sach- und Rechtsmängeln zu verschaffen. Ebenso wie beim Kauf (s § 433 Rz 5) und bei der Miete wird der Unternehmer von seiner Hauptleistungspflicht also nur frei, wenn er mangelfrei liefert; bei Mängeln stehen dem Besteller die Rechte aus § 634 zu. Der Unternehmer ist vorleistungspflichtig, § 641 I. b) Nebenpflichten ergeben sich nach § 241 II aus Inhalt und Zweck des Vertrages, etwa Pflichten zur Information des Bestellers, zur Warnung vor Gefahren, zum Schutz von Eigentum des Bestellers in der Obhut des Unternehmers (Bsp: Verschließen von Kfz im Hof der Reparaturwerkstatt) oder Schutz der Person des Bestellers.

Subsection 1. A Contract for Work
§ 631. Typical examples of obligations imposed by a contract for work
(1) Under the contract for work the contractor has to carry out the promised work, and the customer has to pay the agreed fee.
(2) The object of the contract can be the production or modification of an article, or even the achievement of some other result reached by the provision of work or service.
1. Characteristics of the contract for work. The contract for work sets down the obligation of the "contractor" (for a definition of this term see § 14 note 1) to carry out the promised work (sub-paragraph 1). The contract for work is focused on the results produced (for example: shoe repair, commissioning of architects, carrying goods), while a contract of service (§ 611) is activity-related (for example: a contract for treatment, because the doctor only promises to provide proper treatment; he does not guarantee to provide a cure). In doubtful cases the wishes of the parties as expressed in the contract are the final arbiter. For example, research and development can be the object of a contract for services, as of a work contract; the decisive factor is whether the performance of a service - that is, a procedure in accordance with the rules of science and technology - is owed, or the production of a result – such as a defined outcome from work or the drawing up of reports (more information in BGHZ 151, 330; on the contract law of services de lege ferenda see Wendehorst AcP 2006, 205 279ff). If a manufactured moveable article is to be supplied, then in principle according to § 651 the sale of goods law applies, including if necessary the special regulations concerning the purchase of consumer goods (for details see § 651 note 1 ff), so that the scope of the contract for work law is severely limited (see § 651 note 4). The work to be produced, as sub-paragraph 2 makes clear, can be either a physical object or equally an intellectual, scientific or artistic performance.
2. Duties of the contractor. a) Sub-paragraph 1 identifies the main duty as carrying out the work ordered. In addition, the contractor is required, in accordance with § 633 I, to deliver the work to the person who orders it free from substantive and legal defects. Likewise, in the case of sale (see § 433 Note 5) or hire the contractor only fulfils his main obligation if he supplies the goods free from any defect; if there are defects the customer has the rights listed in § 634. The contractor has a duty to supply the work before receiving payment, see § 641 I. b) Secondary obligations arise from the content and purpose of the contract, in accordance with § 241 II, such as to keep the customer informed, to warn him of any possible risks, and to protect the customer's property when the contractor has custody of it (for example: when a vehicle is being kept in a yard outside a repair workshop) or to protect the customer's person.
