LAW
History of the proceedings
On 9 January 2006 the Republic of State1 filed an Application instituting proceedings against State2, referring to “the refusal by the State2 governmental and judicial authorities to execute an international letter rogatory regarding the transmission to the judicial authorities in State1 of the record relating to the investigation in the Case against X for the murder of Mr. XY”. In its Application State1 maintained that the refusal constituted a violation of State2’s international obligations both under the Treaty of Friendship and Co-operation signed by the two States on 27 June 1977 and the Convention on Mutual Assistance in Criminal Matters between State2 and State1 dated 27 September 1986. State1 further asserted that, in summoning certain internationally protected nationals of State1, including the Head of State, as témoins assistés [legally represented witnesses] in connection with a criminal complaint for subornation of perjury against X in the Mr. XY case, State2 had violated its obligation to prevent attacks on the person, freedom or dignity of individuals enjoying such protection.
In its Application, the Republic of State1 stated that it intended to found the jurisdiction of the Court on Article 38, paragraph 5, of the Rules of Court, adding that it was “confident that the State2 Republic w[ould] agree to submit to the jurisdiction of the Court to settle the present dispute”. In accordance with that Article, the Application by the Republic of State1 was transmitted to the State2 Government.
In a letter dated 25 July 2006 and received in the Registry on 9 August 2006, the State2 Republic specified that it “consent[ed] to the Court’s jurisdiction to entertain the Application pursuant to, and solely on the basis of, said Article 38, paragraph 5”. That consent made it possible to enter the case in the Court’s List on 9 August 2006 and to open the proceedings.
By an Order of 15 November 2006, the Court fixed the time-limits for the filing of a Memorial by State1 and a Counter-Memorial by State2. Those pleadings were submitted within the prescribed time-limits, i.e. 15 March and 13 July 2007 respectively.
Neither Party wishing to submit further written pleadings, and the Court seeing no need for them to do so, the case was ready for hearing.
Economics
GUARANTEES
The Contractor may be required to provide a guarantee for pre-financing of 30% of the amount specified under I.3.1 of the contract, in compliance with article II.4.1 of the draft contract. The Commission reserves the right to cancel the pre-financing foreseen, according to its management risk analysis or in the case the awarded tenderer refuses such pre-financing guarantee, and to modify the final version of the contract accordingly.
GENERAL TERMS AND CONDITIONS FOR THE SUBMISSION OF TENDERS
Participation in tendering procedures is open on equal terms to all natural and legal persons from one of the EU Member States and to all natural and legal persons in a third country which has a special agreement with the Communities in the field of public procurement on the conditions laid down in that agreement.
Where the Plurilateral Agreement on Government Procurement concluded within the WTO applies, the contracts are also open to nationals of the countries that have ratified this Agreement, on the conditions it lays down. In that connection, it should be noted that the services under Annex IIB to Directive 2004/18/EC and the R&D services listed in category 8 of Annex IIA to that Directive are not caught by the Agreement.
Operators in third countries which have signed a bilateral or multilateral agreement with the Communities in the field of public procurement must be allowed to take part in the tendering procedure on the conditions laid down in this agreement. The Commission refuses tenders submitted by operators in third countries which have not signed such agreements for the present call for tender.
Submission of a tender implies acceptance of the terms and conditions set out in this invitation to tender, in the tendering specifications and in the draft contract and, where appropriate, waiver of the tenderer's own general or specific terms and conditions. It is binding on the tenderer to whom the contract is awarded for the duration of the contract.
Once the Commission has accepted the tender, it shall become the property of the Commission and the Commission shall treat it confidentially.
The Commission shall not reimburse expenses incurred in preparing and submitting tenders.
The Protocol on the Privileges and Immunities or, where appropriate, the Vienna Convention of 24 April 1963 on Consular Relations shall apply to this invitation to tender.
Variants are not allowed.

Istruzione del procedimento
In data 9 gennaio 2006 la Repubblica dello Stato 1 ha inoltrato una procedura istituzionale di richiesta contro lo Stato 2 in riferimento al rifiuto opposto dalle autorità giudiziarie e di governo dello Stato 2 di rendere esecutiva una lettera di rogatoria internazionale riguardante la trasmissione alle autorità giudiziarie dello Stato 1 del verbale relativo alle indagini del caso contro X per l’omicidio del Sig. XY. Nella sua domanda lo Stato 1 affermava che tale rifiuto costituiva una violazione degli obblighi internazionali dello Stato 2 sia in virtù del Trattato di Amicizia e Cooperazione siglato dai due Stati in data 27 Giugno 1977, che del Trattato di Reciproca Assistenza in materia di Reati penali tra lo Stato 1 e lo Stato 2 datato 27 Settembre 1986. Lo Stato 1 affermò ulteriormente la propria autorità quando vennero citati in giudizio determinati cittadini tutelati a livello internazionale dello Stato 1, tra cui il Capo dello Stato, come testimoni legalmente rappresentati da un avvocato, in relazione al reato di falsa testimonianza contro X nella causa riguardante il Sig. XY, avendo lo Stato 2 violato il suo dovere di prevenire attacchi alla persona, alla libertà o alla dignità di individui aventi diritto a tale tutela.
Nella sua richiesta, la Repubblica dello Stato 1 dichiarò che intendeva basare la giurisdizione della Corte sull’Articolo 38, paragrafo 5 del regolamento della Corte, aggiungendo che “confidava nel fatto che la Repubblica dello Stato 2 avrebbe accettato di sottomettersi alla giurisdizione della Corte per comporre la presente disputa”. In accordo con detto Articolo, la domanda della Repubblica dello Stato 1 fu trasmessa al Governo dello Stato 2.
In una lettera datata 25 Luglio 2006 e pervenuta a Registro in data 9 Agosto 2006, la Repubblica dello Stato 2 specificava che “consenti[va] alla giurisdizione della Corte di prendere in considerazione la domanda conformemente ed esclusivamente sulla base del succitato Articolo 38, paragrafo 5”. Tale consenso rese possibile l’iscrizione del caso nelle liste dei dibattimenti della Corte il 9 Gennaio 2006 e l’apertura del procedimento.
Con l’ordine del giorno del 15 Novembre 2006, la Corte fissò il limite di tempo per inoltrare un memoriale da parte dello Stato 1 e di un Contro-Memoriale da parte dello Stato 2. Tali dichiarazioni vennero presentate entro i prescritti limiti temporali, cioè il 15 Marzo e 13 Luglio 2007 rispettivamente.
Non avendo nessuna delle Parti inoltrato ulteriori dichiarazioni scritte e non ravvisando la Corte la necessità di farlo, il caso fu pronto per il dibattimento.
ECONOMIA
GARANZIE
Al Contraente può venire richiesto di fornire una garanzia di pre-finanziamento del 30% dell’ammontare come specificato al punto l.3.1 del contratto, in conformità dell’articolo II.4.1 del preliminare di contratto. La Commissione si riserva il diritto di cancellare il pre-finanziamento previsto in accordo alle analisi di rischio del suo organo direttivo o in caso il vincitore dell’asta rifiuti tale garanzia di pre-finanziamento, e di modificare la stesura finale del contratto di conseguenza.
TERMINI E CONDIZIONI GENERALI PER LA PRESENTAZIONE DELLE OFFERTE
La partecipazione alle procedure d’asta è consentita a pari diritti a tutte le persone fisiche e giuridiche provenienti da ciascuno degli Stati Membri dell’Unione Europea e a tutte le persone fisiche e giuridiche di un terzo Paese che abbia uno specifico accordo con le Comunità in materia di approvvigionamenti statali alle condizioni dettate da quell’accordo.
Ove sia presente un accordo plurilaterale sugli approvvigionamenti di Governo anche con Paesi extra comunitari, i contratti sono consentiti anche ai cittadini dei Paesi che abbiano ratificato questo Accordo, alle condizioni previste da questo. In riferimento a ciò va sottolineato che le informazioni nell’allegato IIB della Direttiva 2004/18/EC e le informazioni sulla Ricerca e lo Sviluppo elencati nella categoria 8 dell’Allegato IIA di tale Direttiva non sono contemplate dall’Accordo.
Gli operatori di Paesi terzi che abbiano siglato un accordo bilaterale o multilaterale con le Comunità in campo di approvvigionamento pubblico sono autorizzati a partecipare alle procedure di offerta alle condizioni previste da questo accordo. La Commissione respinge le offerte presentate da operatori di Paesi terzi che non abbiano siglato tali accordi per il presente avviso d’asta.
La presentazione di un’offerta implica l’accettazione dei termini e delle condizioni esposte in questo invito d’asta, nel capitolato d’asta e nel preliminare di contratto e, dove opportuno, in deroga a clausole e condizioni generali o specifici propri dell’offerente. E’ vincolante per l’offerente che si aggiudica il contratto e per la durata del contratto.
Una volta che la Commissione ha accettato l’offerta, questa diverrà di proprietà della Commissione e sarà trattata con la dovuta discrezionalità.
La Commissione non rimborserà le spese contratte nella preparazione e nella presentazione delle offerte.
Il Protocollo riguardante i privilegi e le immunità, o dove competente, l’Accordo di Vienna del 24 Aprile 1963 sulle relazioni consolari si applicheranno a questo invito d’asta.
Non sono consentite varianti.

Travel & Tourism is able to contribute to development which is economically, ecologically and socially sustainable, because it:
• has less impact on natural resources and the environment than most other industries;
• is based on enjoyment and appreciation of local culture, built heritage, and natural environment, as such that the industry has a direct and powerful motivation to protect these assets;
• can play a positive part in increasing consumer commitment to sustainable development
principles through its unparalleled consumer distribution channels; and
• provides an economic incentive to conserve natural environments and habitats which might otherwise be allocated to more environmentally damaging land uses, thereby, helping to maintain bio-diversity.
There are numerous good examples of where Travel & Tourism is acting as a catalyst for conservation and improvement of the environment and maintenance of local diversity and culture.
Providing infrastructure
To a greater degree than most activities, Travel & Tourism depends on a wide range of
infrastructure services - airports, air navigation, roads, railheads and ports, as well as basic infrastructure services required by hotels, restaurants, shops, and recreation facilities (e.g. telecommunications and utilities).
It is the combination of tourism and good infrastructure that underpins the economic,
environmental and social benefits. It is important to balance any decision to develop an area for tourism against the need to preserve fragile or threatened environments and cultures.
However, once a decision has been taken where an area is appropriate for new tourism development, or that an existing tourist site should be developed further, then good infrastructure will be essential to sustain the quality, economic viability and growth of Travel & Tourism.
Good infrastructure will also be a key factor in the industry’s ability to manage visitor flows in ways that do not affect the natural or built heritage, nor
counteract against local interests.
Challenge for the future
Travel & Tourism creates jobs and wealth and has tremendous potential to contribute to
economically, environmentally and socially sustainable development in both developed countries and emerging nations. It has a comparative advantage in that its start up and running costs can be low compared to many other forms of industry development.
It is also often one of the few realistic options for development in many areas. Therefore, there is a strong likelihood that the Travel & Tourism industry will continue to grow globally over the short to medium term.
Of course, if Travel & Tourism is managed badly, it can have a detrimental effect - it can damage fragile environments and destroy local cultures.
The challenge is to manage the future growth of the industry so as to minimise its negative impacts on the environment and host communities whilst maximising the benefits it brings in terms of jobs, wealth and support for local culture and industry, and protection of the built and natural environment.

La combinazione di turismo e infrastrutture eccellenti determina e sostiene i vantaggi economici, ambientali e sociali. È importante bilanciare qualsiasi decisione riguardo lo sviluppo di un’area turistica, tenendo conto del bisogno di preservare la fragilità di determinati ambienti e culture altrimenti minacciati.
Tuttavia, dopo aver preso la decisione di destinare un’area a sviluppo turistico, o aver predisposto lo sviluppo ulteriore di un sito turistico esistente, saranno essenziali delle buone infrastrutture per supportare qualità, prospettive economiche e crescita dell’industria turistica.

Naturalmente se l’attività turistica è amministrata malamente può avere un effetto dannoso – può danneggiare gli ambienti fragili e distruggere le culture locali.
La sfida è quella di gestire la crescita futura dell’industria in modo tale da minimizzare i suoi effetti negativi sull’ambiente e le comunità ospitanti pur massimizzando i benefici che ne derivano in termini di occupazione, ricchezza e supporto all’industria e cultura locali, e a salvaguardia dell’ambiente naturale e costituito.
