It has recently come to our attention that Xxx Xxxxxx Group S.A., D.E., C.V. ("XXXX") is misrepresenting itself as an authorized licensee of Xxxxxx Xxxxxx Company, Inc. (“XXX”) by wrongfully using the Xxx Xxxxxx® trademark (see enclosed promotional communications). XXX strictly regulates the licensing of its proprietary technology and registered trademarks.
Please be advised that XXX is the sole and exclusive owner of the Xxxxxx® trademark including, but not limited to, Xxxxxx Trademark Serial Nos. ______ and _____; Xxxxxx Trademark Registration Numbers 2,281,184, 3,646,509, 3,642,756, and 3,688,489; Xxxxxx Trademark Registration Number XXX693852; Xxxxxx Trademark Registration Numbers 348,149 and 380,854; Xxxxxx Trademark Registration Number 1,255,833; Xxxxxx Trademark Registration Number 119,301; XXX Trademark Registration Numbers 123,362 and 123,363; and Xxxxxx Trademark Registration Number 001328996. Xxxxxx® is used by XXX and its authorized licensees to represent the high quality foundation and ground improvement services of XXX.
XXX is also the sole and exclusive owner of the rights in and to Xxxxxx Patent Registration Nos. 241,080 and 249,041; Xxxxxx Patent Application Nos. XX/a/2007/014204, XX/a/2008/004330, and XX/a/2010/004376; as well as other world wide patents, the subject matter of which relate to foundation and ground improvement technology.
XXX has expended a substantial amount of time, resources, and effort developing and protecting its registered trademarks and proprietary ground improvement technology including, but not limited to, the Xxxxxx® system, the Impact® system, and the Intermediate Foundation® system, collectively. Xxxxxx's misrepresentation that it is an authorized XXX licensee is in violation of XXX's intellectual property rights. Accordingly, XXX hereby demands that Xxxxxx immediately cease and desist from any further use of the Xxxxxx® trademark and unauthorized representations that XXX is an authorized installer of Xxxxxx® systems. Xxxxxx is also hereby notified that if Xxxxxx engages in construction practices that infringe upon the patents and proprietary technology of XXX, that XXX will proceed with all available legal remedies.
It is the policy of XXX to respect the valid intellectual property rights of others. We trust you understand the expectation that the intellectual property rights of XXX will be similarly respected. We also trust that you appreciate the resolve of XXX concerning this important issue, which goes to the core of the business it has invested substantial resources to build.

Así mismo, XXX el único y exclusivo dueño de los derechos y el Registro de Patente en Xxxxxx No. 241,080 y 249,041; Aplicación de Patente en Xxxxxx No. XX/a/2007/014204, XX/a/2008/004330, y XX/a/2010/004376; además de muchas otras patentes a nivel mundial, todas relacionadas al tema de cimientos y tecnología para el mejoramiento de suelos.
XXX ha empleado una importante cantidad de tiempo, recursos y esfuerzo desarrollando y protegiendo sus marcas registradas y derechos sobre sus tecnologías para el mejoramiento de suelos incluyendo, entre otros, el Sistema Xxxxxx®, el Sistema de Impacto®, y el Sistema de Cimientos Intermedios®, colectivamente. El falso estatus de Xxxxxx como representante autorizado de XXX viola de manera directa los derechos de propiedad de XXX. Por consiguiente, XXX exige aquí que xxxxxx termine inmediatamente y desista del XXX de la marca registrada Xxxxxx® y del título de representante e instalador autorizado de Xxxxxx® y sus sistemas. Así mismo, le estamos notificando que en caso de que Xxxxxx participe en procesos de construcción que atenten contra las patentes y derechos sobre las tecnologías de XXX, este último recurrirá a las respectivas herramientas e instancias legales.
