Source text - French Devant mon regard perdu s’étendait Big Apple « on the rocks », découpé au fusain. Les gratte-ciels aux racines enneigées, gainés d’acier, élevaient leurs arêtes luisantes sous la lune, comme la tranche d’un couteau. Étouffé par la neige, le crissement des fer- railles des gigantesques ponts et des métros aériens me parvint jusque sur la peau.
M’arrachant aux flots mêlés de rage et de tris- tesse, la vitre se mit à claquer sous une rafale sou- daine, décrochant le gel en longues rayures verticales. Comme si les spectres, là, dehors, venaient d’aperce- voir ma silhouette et tentaient de m’extirper de mon linceul de fortune.
Venez, bande de salopards, venez me chercher, gro- gnai-je à voix haute en exhalant le tabac qui glissa le long des griffes invisibles.
Je vous attends.
Newark et La Guardia étaient fermés à cause des intempéries. J’arrachai tant bien que mal sur Inter- net un vol pour San Francisco qui ne décollait qu’en début d’après-midi, de JFK.
Délaissant ma barbe de quatre jours, je pris une longue douche et m’habillai chaudement. Deux aspi- rines engloutis avec un café passé dans le filtre de la veille firent office de cataplasme salvateur. En fond sonore, la radio diffusait un message de notre Prési- dent, appelant au calme.
Je décidai de sortir, sans but précis. Une gifle gla- ciale emplit mes poumons de stalagmites, et figea des larmes qui avaient du mal à s’épancher. Le ciel d’un désert bleu laiteux immaculé dévoilait les pre- mières lueurs.
7 heures.
Groggy, je m’accordai quelques minutes avant de prendre une direction. Heureusement restaient Doumé et son bar. Mon antre. J’expédiai la clope d’une chique- naude, relevai le col du blouson bien que ma gorge fût entraînée à se tendre devant les guillotines morales, et je soufflai dans mes doigts repliés.
Doumé libérait les arômes de café, au moment où mon mètre quatre-vingt-deux apparut. D’habitude je faisais la fermeture, rarement l’ouverture, mais il ne posa aucune question devant cette incongruité. Il n’en posait du reste jamais : une plaque de téflon, tellement les événements n’avaient aucune prise sur lui. Il avait ainsi la confiance des gars du milieu et des truands du temps où je les poursuivais. J’avais eu parfois droit – extrême sollicitude – à un discret hochement de tête en guise d’indication, lorsque mes enquêtes patinaient. Mais comme dans les saloons, la règle commandait de déposer ses flingues à l’entrée.
Mes pas craquèrent sur des pelures de cacahuètes. Une fois l’an, il distribuait des kilos d’arachides, et tout ce que devait faire la clientèle, c’était de jeter les écorces par terre. En marchant dessus, on libérait une huile qui lubrifiait le parquet brun.
Je l’aidai machinalement à remettre les chaises sous les regards qu’il me lançait à la dérobée. Ma peine sembla le toucher, il revint de la cuisine avec des œufs au bacon et un sandwich au chorizo à la tête de murène. Le tout accompagné d’une bourrade ami- cale, et arrosé d’un café fort et d’un confident retors nommé Old Crow.
Puis Doumé mit CNN sans le son, et régla une fréquence jazz sur sa stéréo. « Soul eyes » par Mal

Waldron, Dianne Reeves et sa voix de velours rauque. Il savait que ça me calmait.
Je levai la tête. Faute d’autres actualités majeures, le crash survenu sur San Francisco balayait toujours l’écran en un carnaval sordide d’images dissociées qui bouillonnaient dans tous les esprits : remorqueurs sou- levant des fragments, débris et corps flottants, inter- views d’experts, familles incrédules et en larmes, sirènes. L’hypothèse d’un attentat revenait en boucle. Maudite culture de l’instantané. Le monde devait tout savoir, surtout quand ça pissait le sang chez les autres. Twitter, Facebook, Internet, théâtres des temps modernes. Mi- peep-show, mi-arènes antiques. L’avidité de l’excitation en esclave affranchi. Tout, tout de suite. Même les filles se déshabillaient trop vite avant de faire l’amour.
J’absorbai avidement les infos, soulagé de cette anes- thésie bienveillante. On distinguait clairement la chute de la section avant retournée sous la carlingue prin- cipale, les ailes arrachées en leurs extrémités, suivie de la dérive cisaillée en un tronçon. Sous le regard du monde entier désormais, tant les vidéos faisaient le buzz.
Je frissonnai : jamais deux avions ne s’étaient écrasés au même endroit, et c’est là-bas que je devais me rendre. Mon regard se détourna, puis je feuilletai le cahier sports du Newsday. Mais la terrible nouvelle de Fla-
nagan et son avertissement revenaient en boucle. Qu’avait voulu dire ce connard ?
J’observai le téléphone, hésitant à appeler la maison
familiale. Je ne voulais pas y croire. Ce taré m’avait fait une sale blague. Ce n’était pas possible autrement.

Quatre heures encore avant de décoller. Je me diri- geai vers mon bureau de détective, au cinquième étage du 278 Pearl Street à l’angle de Beekman, pointe sud de Manhattan.
Mes doigts de pied commençaient à s’engourdir. Downtown, les pelleteuses charriaient la poudreuse en jets désordonnés. Les fumées des aérations stagnaient en génies grisâtres suspendus. Je m’arrêtai au passage dans une église pour me recueillir.
L’ambiance du bureau que j’atteignis une demi- heure plus tard m’enveloppa comme un bain bien chaud. Mon passeport et une poignée de cash ces- sèrent de dormir au fond du coffre.
Je déposai un mot à mon associée Carol, couchai le cadre d’une photo ancienne de ma famille réunie au complet, et m’enfonçai dans les tripes béantes du métro pour rejoindre JFK.
Face à moi, ballotté par le chuintement de la rame, un SDF en guenilles psalmodiait en boucle, les yeux extatiques levés vers le ciel, la même imprécation : « le soleil se levait sur la terre quand Lot entra dans le Tsoar. Alors l’Eternel fit tomber sur Sodome et Gomorrhe une pluie de souffre et de feu ».
Attendre l’inéluctable, c’est en ce sens que je faisais corps avec ma ville.
« Et prépare-toi à avoir la surprise de ta vie ! » J’eus soudain envie que le métro accélère.
La dépouille mortelle avait assez attendu.
Translation - English Before my glassy gaze stood the Big Apple, “on the rocks”, drawn in charcoal. SnowOcapped skyscrapers, sheathed in steel, raised their gleaming ridges to the moon, like the sharp edge of a knife. Muffled by the snow, the screeching sounds of gigantic bridges and sky trains made their way over to prickle my skin.
Snatching me away from waves of sadness and suffering, the window started to chatter under the strain of a sudden gust, unhooking the ice in long vertical stripes. As if ghosts, floating out there, had just noticed my shadow and were trying to haul me out of my shroud of fortune.
Come here you bastards, come and get me, I growled out loud, exhaling smoke that slid along their invisible claws.
I’m waiting for you.
Both Newark and La Guardia were closed due to weather conditions. After struggling for a few minutes I managed to wrestle a flight from the Internet to San Francisco, that wouldn’t leave till early afternoon from JFK.
Neglecting my fourOday stubble, I took a long shower and dressed warmly. Two Advil downed with coffee strained through yesterday’s filter served as poultice. In the background, the radio broadcast a message from our President, urging for calm.
I decided to go out, with no specific goal. An icy slap filled my lungs with stalactites and froze the tears that had trouble pouring forth. The sky, mirroring a pristine milky blue desert, revealed the first streaks of dawn.
Seven o’clock.
Groggy, I granted myself a few minutes before picking my destination.
Thankfully there was still Doumé and his bar. My lair. I tossed my smoke with a flick of the fingers, zipped up my coat collar although my throat was used to straining before moral guillotines, and blew on my folded fingers.
Doumé was releasing the warm aromas of coffee by the time all 6 feet of me appeared. I was usually there for closing time, but he didn’t question this incongruity. He actually never did: a real Teflon sheet, events literally had no sway over him. As such he’d gained the trust of the mob guys and gangsters from way back when I was pursuing them. I’d sometimes been granted – out of extreme
solicitudeO a discreet nod by way of indication, when my investigations were dragging on. Just like saloon rules dictated though, guns were to be left at the door.
My footsteps crunched on peanut peelings. Once a year, he handed out pounds of peanuts to his customers and all they had to do was chuck the shells to the ground. Walking on them released the oil that greased the dark wooden floors. I mechanically helped him to set up the chairs under the watchful glances he sneaked at me. My sorrow seemed to move him, he came back from the kitchen with bacon and eggs and an eel head chorizo sandwich. All of this accompanied by a friendly shove and washed down with strong coffee and of a shot of that trusted wily friend we know as Old Crow.
Then Doumé turned on CNN with no sound, and tuned into a jazz station on his stereo. “Soul eyes”, by Mal Waldron, Diana Reeves singing in hoarse and velvety tones. He knew it soothed me.
I looked up. For want of other major news, the crash in San Francisco was still making headlines with a carnival of dissociate squalid images that simmered in everyone’s minds: tow trucks lifting fragments, debris and floating bodies, interviews with experts, families shedding tears and refusing to believe, the shrill sound of sirens. The hypothesis of a terrorist attack brought up over and over again. Bloody snapshot culture. Everyone needing to know it all, especially with blood being shed somewhere else. Twitter, Facebook, Internet, all theaters of modern times. HalfOpeepOshow, halfORoman amphitheater. The excited greed of an emancipated slave. Everything, right away. Even the women shed their clothes too quickly before slipping into bed and making love.
I eagerly soaked up the news, calmed by their indulgent anesthesia. You could easily make out the scraps from the overturned front section of the plane under the main cabin, the wings torn from their tips, followed by the tailfin clipped into a single log. The videos created so much buzz that the entire world was watching.
I shivered: no two planes had ever crashed in the same spot, yet that’s where I had to go.
I turned away and started flipping through the Sports section of Newsday. But I couldn’t keep my mind off of Flanagan’s terrible news and dire warning.
What did that asshole mean?
I eyed my phone, debating whether to call the family home. I just didn’t want to believe it. That lunatic was playing a sick prank. There was no other option.
Fuck you Flanagan!
Four hours to go before boarding. I headed towards my PI office, on the fifth floor of 278 Pearl Street and the corner of Beekman, on the southern tip of Manhattan.
My toes were getting numb. Downtown, snowplows were sweeping powder in chaotic spews. The smoke drifting out of air ducts lingered in the air like bleak spirits in suspension. I stopped in a church along the way to engage in private prayer.
The atmosphere at the office swathed me like a nice warm bath. My passport and a handful of cash were taken from their slumber deep inside the safe.
I left a note for my partner Carol, turned over the frame of an old family picture that assembled us all, and sunk into the cavernous bowels of the subway to get to JFK.
Sitting in front of me was a homeless man in old rags, shunted by the swish of the carriage, eyes raised in ecstasy to the heavens, chanting the same imprecation in a continuous loop: “The sun was risen on the Earth when Lot came to Zoar. Then the Lord rained on Sodom and on Gomorrah brimstone and fire from the Lord out of heaven.”
Waiting for the unavoidable, that’s how I made one with my city.
“And get ready for the surprise of your life!”
I I suddenly wished the subway would go faster.
The mortal remains had waited long enough.
French to English: translation with regards to obligations of a EWC - extract General field: Law/Patents Detailed field: Human Resources
Source text - French 1) Vérifier comment les membres du EWC peuvent communiquer à leur syndicat au niveau local sans remettre en cause leur obligation de confidentialité
Tout d’abord, le principe de confidentialité est prévu à l’article 8 de la Directive 2009/38/CE du 6 mai 2009 : « Les États membres prévoient que les membres du groupe spécial de négociation et du comité d’entreprise européen ainsi que les experts qui les assistent éventuellement ne sont pas autorisés à révéler à des tiers les informations qui leur ont été expressément communiquées à titre confidentiel ».
Cette obligation a été transposée en droit français à l’article L. 2342-10 du Code du travail : « Les membres du comité d'entreprise européen institué par accord ainsi que les experts qui les assistent sont tenus :
1° Au secret professionnel pour toutes les questions relatives aux procédés de fabrication ;
2° A une obligation de discrétion à l'égard des informations présentant un caractère confidentiel et données comme telles par l'employeur ».
En outre, la communication des membres du EWC aux instances a été encadrée par l’article
L. 2343-12 en prévoyant que lesdits membres « informe les représentants du personnel des entreprises du Groupe ou, à défaut de représentants, l'ensemble des salariés, de la teneur et des résultats de la procédure d'information et de consultation (…), dans le respect des dispositions relatives au secret professionnel et à l'obligation de discrétion ».
Par ailleurs, sur ce sujet, la plupart du temps, les entreprises ayant mis en place un EWC se contente de reprendre ces textes.
Les membres du EWC pourront donc communiquer à l’issue des réunions du Comité dans le respect de l’obligation de discrétion à l’égard des informations présentées par la Direction comme confidentielle.
2) Etudier la possibilité que les membres du EWC demandent une réunion extraordinaire dès lors que la Direction n’a pas convoqué le EWC alors qu’il aurait dû le faire
Dans la présente version d’accord de mise en place du Comité d’entreprise européen d’xxx, dès lors que « surviennent des circonstances exceptionnels affectant considérablement des salariés situés dans au moins deux Etats », le Bureau peut demander à la Direction une réunion pour décider la tenue ou non d’une réunion extraordinaire. A ce stade, une décision conjointe est prise même si, en cas de désaccord, la position de la Direction prévaut puisque c’est lui qui convoque le EWC.
Selon nous, la rédaction actuelle de l’accord répond en partie à la demande de xxx: elle souhaite que le EWC puisse demander avertir la Direction qu’une réunion extraordinaire ait lieu (tout en laissant à la Direction la prérogative de la convocation) alors que dans la rédaction actuelle, le Bureau peut s’entretenir avec la Direction afin de décider de l’opportunité de la tenue d’une réunion extraordinaire.
Translation - English 1) Determine how EWC members could communicate with their unions locally without jeopardizing their confidentiality obligation.
For starters, the principle of confidentiality is provided for under article 8 of Directive 2009/38/CE dated May 6th, 2009: “Member States shall provide that members of special negotiating bodies or of European Works Councils and any experts who assist them are not authorized to disclose any information which has been expressly provided to them in confidence.”
This obligation was transposed into French Law in Article L. 2342-10: “Members of the European Works Council provided for by the Agreement as well as any experts who assist them are bound:
1° by professional secrecy with regards to all issues relative to the manufacturing process;
2° by an obligation to exercise discretion with respect to any privileged information provided to them in confidence by the employer.”
Moreover, communication by EWC members to the unions has been regulated by article L. 2343-12 by ensuring that said members “inform the representatives of the Group’s establishments, or in the absence of representatives, the workforce as a whole, of the content and outcome of the information and consultation procedure (…) in compliance with the legal provisions relative to professional secrecy and the obligation to exercise discretion”.
Furthermore, on this subject, companies having established an EWC most often simply adopt these texts.
Members of the EWC shall hence be able to communicate after the Council’s meetings in compliance with the obligation to exercise discretion with regards to information provided by Management in confidence.
2) Consider the possibility that EWC members may request an extraordinary meeting from the moment Management does not convene the EWC when it should do so
In the present version of the agreement on the establishment of a European Works Council within the xxx, as soon as “exceptional circumstances arise that may considerably affect employees located in at least two States”, the Office may request a meeting with Management to decide if an extraordinary meeting should be held or not. At this stage, a joint decision shall be taken even if, in case of disagreement, Management’s decision shall prevail seeing as it is the one to have convened the EWC.
According to us, the agreement as currently drafted already partly satisfies xxx request: she would like for the EWC to be allowed to inform Management of the need to hold an extraordinary meeting (whilst giving Management the prerogative to convene) whereas in the current version, it is the Office (and not the EWC) who may enter in a dialogue with Management in order to jointly decide whether such an extraordinary meeting should take place.
