On the eve of the collapse of Communist rule in Central and Eastern Europe (CEE), a doyen of international political science, Professor Klaus von Beyme, summarised his conclusions in a comparative study on judicial review in the following manner: “Judicial review works most effectively and intensely in those political systems in which the Rechtsstaat had been established before the advent of democracy, and where federal structures functioned as an obstacle to the majority principle dominating parliamentary democracies”. According to this theory, certainly unimpeachable in 1988 when these words were published, judicial review was to have little chances of operating successfully in CEE after 1989: in all of the countries in this region the advent of democracy preceded the establishment of the Rechtsstaat, and only one (Russia) is a federation. And yet, in most of these countries, judicial review by constitutional courts became both “effective” and “intense”, to use von Beyme’s terminology: it has been “intense” in the sense that these courts have not shied away from invalidating often very important pieces of legislation, and “effective” in that other institutional actors in each political system have exhibited a high degree of compliance with the decisions of the constitutional courts.
One explanation for the impressive emergence of constitutional courts in all post-communist states of CEE, notwithstanding the absence of the federal or Rechtsstaat-related roots identified as necessary by von Beyme, could be that it was a case of a simple and rather mechanical importation to post-authoritarian states of an institutional design that had proved successful in other countries.

W przededniu upadku systemu komunistycznego w Europie Środkowo-Wschodniej nestor międzynarodowych nauk politycznych, profesor Klaus von Beyme, w studium porównawczym kontroli konstytucyjności prawa zebrał wnioski swoich dociekań, stwierdzając: „Sądowa kontrola prawa dokonywana jest w sposób najbardziej efektywny i prowadzona najintensywniej w tych systemach politycznych, w których państwo prawa (Rechtsstaat) zaistniało przed nastaniem demokracji, oraz tam, gdzie struktury federalistyczne stanowiły przeszkodę dla zasady rządów większości, dominującej w demokracjach parlamentarnych”1. Zgodnie z tą teorią - z pewnością niepodważalną w roku 1988, kiedy słowa te zostały opublikowane - nie istniały zbyt duże szanse na poprawne funkcjonowanie kontroli konstytucyjnej prawa w Europie Środkowo-Wschodniej po roku 1989; we wszystkich krajach tego regionu nadejście demokracji poprzedziło powstanie państwa prawa, przy czym tylko jeden kraj (Rosja) był federacją. Niniejsze opracowanie powstało w ramach projektu badawczego pt. „Model dopuszczalnej ingerencji w prawa i wolności jednostki w procesie karnym”, finansowanego przez Narodowe Centrum Nauki. Celem projektu była kompleksowa analiza granic ingerencji w prawa i wolności jednostki w polskim procesie karnym. Dopuszczalność ograniczania praw i wolności jednostki w toku postępowania karnego wymaga precyzyjnego stwierdzenia, w jakich sytuacjach i w ja-kim zakresie jest to możliwe. Celem prowadzonych badań dogmatycznych było zatem ustalenie, czy możliwe jest opracowanie uniwersalnych kryteriów oceny zakresu dopuszczalnej ingerencji we wszystkie chronione przez Konstytucję RP oraz umowy międzynarodowe prawa i wolności jednostki, które mogą być ograniczane w toku postępowania karnego. W razie braku takiej możliwości celem badań było wypracowanie takiego mechanizmu w odniesieniu do konkretnych praw i wolności jednostki. Problematyka ingerencji w prawa i wolności jednostki w procesie karnym stanowi bez wątpienia jedno z fundamentalnych zagadnień w teorii procesu karnego, a także w praktyce stosowania prawa. Wpisuje się ona w podstawowy dla państwa prawa i liberalnej demokracji problem relacji między władzą a jednostką. Z perspektywy procesu karnego zagadnienie to nieodłącznie wiąże się też z kwestią rzetelności postępowania karnego, która wyznacza podstawową oś dla prowadzonych w doktrynie rozważań naukowych. Teoretyczna analiza obowiązujących instytucji procesowych jest niemożliwa bez omówienia wpływu tych instytucji na sferę praw i wolności jednostki. Prowadzone badania mają więc kluczowe znaczenie dla rozwoju nauki procesu karnego, wpisując się w główny nurt badań karnoprocesowych, nie tylko w Polsce, ale także w Europie. Mają one także duże znaczenie dla funkcjonowania wymiaru sprawiedliwości. Wypracowane wyniki w założeniu mają stworzyć warunki dla optymalizacji i racjonalizacji stosowania środków ingerujących w prawa i wolności jednostki w postępowaniu karnym. Jeżeli zważyć, że ingerencja ta może mieć daleko idące negatywne skutki, zwłaszcza gdy dotyczy wolności osobistej czy prawa własności, to cel przeprowadzonych badań wydaje się kluczowy dla zapewnienia jednostce efektywnej ochrony jej praw w procesie karnym.
Translation - English Introduction
This book has been written as part of the research project The Model of Acceptable Interference with the Rights and Freedoms of an Individual in the Criminal Process, which was financed by the National Science Centre. This project was designed to comprehensively analyse the limits of interference with the rights and freedoms of individuals in the Polish criminal process. In order to establish that certain rights and freedoms of an individual can be lawfully restricted in the course of criminal proceedings, one needs to determine in what situations such restrictions are acceptable and what the acceptable extent of such restrictions is.
Therefore, the doctrinal studies undertaken here aimed to determine whether or not it is possible to develop some universal criteria for the assessment of the scope of acceptable interferences with any of the rights and freedoms of individuals that are protected in the Constitution of the Republic of Poland and international treaties, which can be applied in the course of criminal proceedings. If the answer to the above question turned out to be negative, the research would then attempt to develop criteria specific for particular rights and freedoms of individuals.
Interferences with the rights and freedoms of individuals in the criminal process are clearly a fundamental area for both the theory of the criminal process and the practical application of criminal law. This is an inherent part of the relationship between the government and the individual, which itself is a key aspect of a state ruled by law and a liberal democracy. From the perspective of the criminal process, such interferences undeniably affect the fairness of the proceedings, which sets a basic direction of the research conducted by criminal law scholars.
No theoretical review of the existing measures of the criminal procedure is possible without a description of how these measures affect the rights and freedoms of individuals. This is why the present research is crucial for the development of the theory of the criminal process becoming well-aligned with the mainstream of both Polish and European studies on the rules of criminal procedure. The research is also significant for the operation of the justice system. Its results are expected to create conditions for the optimised and rational application of measures interfering with rights and freedoms of individuals in criminal proceedings.

Source text - Polish Dopuszczalność nielegalnie uzyskanych dowodów w orzecznictwie międzynarodowych trybunałów karnych – uwagi ogólne
Orzecznictwo dotyczące dopuszczalności nielegalnie uzyskanych dowodów zostanie omówione w pierwszej kolejności w odniesieniu do trybunałów jugosłowiańskiego i rwandyjskiego. Jako że powstały one wcześniej od MTK oraz mają większy dorobek orzeczniczy, krok ten wydaje się uzasadniony. Warto również zauważyć, że MTK odwołuje się w swojej praktyce orzeczniczej do dorobku trybunałów ad hoc czerpiąc z niego inspiracje dla własnych rozstrzygnięć. Na przedpolu analizy praktyki dopuszczania dowodów w postępowaniu przed MTK oraz Trybunałami jugosłowiańskim i rwandyjskim warto jednak wspomnieć, że problematyka ta jest relatywnie nowa. Nie była ona bowiem przedmiotem szczególnej refleksji w postępowaniu przed trybunałem norymberskim. Statut Trybunału norymberskiego traktował o dopuszczalności dowodu, ale wyłącznie z perspektywy jego wartości, a kwestia ta nie była poddawana w toku postępowania szczegółowym analizom. W doktrynie w kontekście dopuszczalności dowodów podaje się przykład procesu Hansa Fritzsche, który w jego toku zarzucał, że przyznanie się do winy zostało wymuszone przez Rosjan. M. Klamberg stwierdza, że skoro doszło do uniewinnienia Fritzsche’a, to przyznanie się nie mogło zostać uznane za wiarygodne. Zarazem autor ten słusznie zwraca uwagę, że zarzut Fritzsche’a poddany został analizie na etapie oceny dowodów, a nie na etapie badania dopuszczalności dowodu, jak to się dzieje obecnie. Powyższe, choć nie pozwala na sformułowanie daleko idących wniosków, to jednak wydaje się potwierdzać małą wagę, jaką przywiązywano do zagadnienia dopuszczalności dowodu w procesie norymberskim. Jak podkreśla W. A. Schabas ewolucja, która nastąpiła w tej materii jest wynikiem m.in. wpływu międzynarodowego prawa praw człowieka, które wymusiło uwzględnienie w postępowaniach przed trybunałami problematyki wykluczania niektórych dowodów.
Omawiając orzecznictwo dotyczące dopuszczalności nielegalnie uzyskanych dowodów przed międzynarodowymi trybunałami karnymi warto także na wstępie zaakcentować, że nie są one związane krajowymi przepisami prawa dowodowego. Wynika to z charakteru sui generis reguł prawa dowodowego funkcjonujących przed trybunałami. To zatem jakie jest pochodzenie danej instytucji prawnej, czy też w jaki sposób określone dowody są przeprowadzane przed sądami krajowymi nie może mieć decydującego znaczenia dla sposobu prowadzenia postępowania dowodowego przed trybunałami. Procedura przed tymi organami musi bowiem wychodzić naprzeciw celom i specyfice międzynarodowego postępowania karnego.
Translation - English Admissibility of illegally obtained evidence in the case law of international criminal courts – general discussion
This paper will first review the case law of the admissibility of illegally obtained evidence in relation to the Yugoslavia and Rwanda Tribunals. This approach seems reasonable as the establishment of the two tribunals pre-dates the creation of the ICC, and they have developed a more extensive body of case law than the ICC. In its jurisprudence the ICC has notably referred to the case law of ad hoc tribunals, which serve as a source of inspiration for the Court’s own rulings. Before taking on the substantial analysis of the practices regarding the admission of evidence in proceedings before the ICC and the Yugoslavia and Rwanda Tribunals, it should be mentioned that the very topic is relatively new. This is the case because the legality of evidence was not particularly discussed in proceedings before the Nuremberg Tribunal. The Charter of the Nuremberg Tribunal dealt with the admissibility of evidence, but only from the perspective of its value, and, moreover, this issue was not analysed in detail during the proceedings. The legal scholarship on admissibility of evidence makes mention of the trial of Hans Fritzsche, who alleged during the proceedings that his admission of guilt had been forced by the Soviets. M. Klamberg argues that since Fritzsche was acquitted, his admission of guilt must have been denied credibility. Klamberg also correctly observes that the charges against Fritzsche were reviewed at the stage of the assessment of evidence, rather than during the review of the admissibility of evidence, as is now the case. Even though the above example cannot serve as a basis for far-reaching conclusions, it seems to confirm that the topic of admissibility of evidence was generally disregarded during the Nuremberg Trial. W. A. Schabas emphasises that the evolution that took place in the area of the admissibility of illegally obtained evidence was driven by, among other things, the influence of international human rights law which pressurised international tribunals to take note of the rules governing the exclusion of certain types of evidence in their proceedings.
At the outset of an analysis of the case law on admissibility of illegally obtained evidence before international criminal courts, it is worth noting that such tribunals are not bound by any domestic rules of evidence. This is a consequence of the distinctive nature of evidentiary rules applied by the tribunals. Therefore, either the origin of a given legal institution or the method of evidence-taking used by domestic courts cannot be a decisive factor influencing the manner in which evidentiary proceedings before the tribunals are handled. The rules of procedure applied by these bodies must therefore be in line with the objectives and specific features of international criminal procedure.

Source text - Polish Sądy krajowe w wielu przypadkach stosują bezpośrednio lub pośrednio prawo UE, zgodnie z zasadami stosowania prawa unijnego w krajowym porządku prawnym. W sprawach tzw. unijnych (tzn. z elementem prawa unijnego) mogą lub są zobowiązane zadawać pytania o wykładnię (i ewentualnie o ważność) prawa unijnego. Wspomniane pytanie prejudycjalne (tzw. pytanie wstępne) przewidziane jest w traktatach stanowiących Unię, tj. w art. 19 ust. 3 lit. b) Traktatu o Unii Europejskiej i w art. 267 Traktatu o funkcjonowaniu Unii Europejskiej. To instrument, który umożliwia zwrócenie się do Trybunału przez sądy krajowe z pytaniami dotyczącymi wykładni prawa Unii lub ważności aktów wydawanych przez instytucje, organy lub jednostki organizacyjne Unii. Procedura prejudycjalna jest wykorzystywana, gdy sąd krajowy rozpatruje tzw. sprawę unijną i ma wątpliwości co do wykładni (lub ważności) prawa UE, a w efekcie orzeczenie Trybunału jest niezbędne do wydania orzeczenia przez sąd krajowy. Na podstawie art. 267 TFUE sądy krajowe mogą wówczas (a w pewnych wypadkach muszą) zwrócić się do Trybunału Sprawiedliwości z wnioskiem o wydanie orzeczenia prejudycjalnego. Procedura ta powinna być stosowana w razie wystąpienia przed sądem krajowym nowego zagadnienia interpretacyjnego, które ma generalne znaczenie dla jednolitego stosowania prawa Unii lub też w sytuacji, w której istniejące orzecznictwo wydaje się nie dostarczać wyjaśnień koniecznych w świetle nowej sytuacji faktycznej lub prawnej.
Translation - English National courts apply, directly or indirectly, EU laws in a multitude of cases, in accordance with the principles governing the application of EU law in national legal systems. In “EU cases”, or cases with an EU dimension, national courts may (or are obliged to) ask questions about the interpretation – and, possibly, validity – of EU law. The aforementioned preliminary reference is provided for in Article 19(3)(b) of the Treaty on European Union (“TEU”) and Article 267 of the Treaty on the Functioning of the European Union (“TFEU”). This measure is designed to enable national courts to bring before the Court of Justice questions concerning the interpretation of EU law or the validity of acts adopted by the institutions, bodies, offices or agencies of the Union. The preliminary ruling procedure is used whenever a national court hearing an EU case has doubts regarding the interpretation (or validity) of EU law and a ruling of the CJEU is necessary for the rendering of the national court’s decision. Pursuant to Article 267 TFEU, in such a situation national courts may (or, in certain circumstances, have to) submit a request for a preliminary ruling to the Court of Justice in Luxembourg. This procedure should be used when a new question of interpretation is raised before the national court that is of general interest for the uniform application of EU law, or where the existing case-law does not appear to provide the necessary guidance in a new legal context or set of facts.
