Source text - English Depuis fort longtemps le droit français a prévu des règles originales pour ces actes très courant que sont les contrats dans le cas où ils sont passés par des personnes publiques. Cette originalité s’est illustrée, du moins pour une bonne partie de ces contrats, par un encadrement du processus de choix du cocontractant et par des dérogations au principe de la force obligatoire des contrats . Le droit communautaire issu du traité de Rome du 25 mars 1957 n’avait pas lieu à l’origine de modifier cet état des choses : aucune disposition ne faisait allusion à la passation ou à l’exécution des contrats publics, l’objectif proprement économique du traité n’étant pas alors perçu comme justifiant une intrusion dans la sphère publique. Certes, le droit communautaire dérivé a, dès les années 70, produit des directives visant à ouvrir les marchés publics à la concurrence européenne, mais ces directives étaient alors construites sur le modèle français, au point qu’il avait semblé inutile de les transposer en droit interne. Aborder le thème de l’influence du droit communautaire sur le droit français des contrats publics il y a seulement 20 ans aurait ainsi relevé de la gageure : comment parler d’influence communautaire quand le droit communautaire avait trouvé dans le formalisme des règles françaises de passation des marchés publics des sources évidentes d’inspiration ? Si d’influences il était question, ce ne pouvait être que de manière ascendante et non descendante, du droit français vers le droit communautaire et non l’inverse .
Translation - French For many years now, France has had in her legislation specific rules concerning those very common deeds which are the contracts between public legal entities. The specialty of these rules appears, at least in the great majority of the these contracts, in the supervising of the process by which the co-contracting party is chosen and through exemptions to the principle of the compulsory force of the contracts. The European community law issued by the treaty of Rome on the 25th of March 1957 was not supposed to modify them: there were no articles referring to the way public contracts should be awarded or implemented. The actual aim of the economic treaty was not considered then as a reason to intrude into the public domain. Still, even though, from the 1970s, guidelines aiming at opening the government contracts to European competition stemmed from the European community law, they were at the time built on the French model so much that it seemed that there was no point making any modification to the internal laws. To deal with the issue of the influence of the community law over the French government contracts laws would have been a true challenge even twenty years ago. How could one talk of an EC influence when the community law had found in the rigor of the French rules for awarding governments contracts such obvious sources of inspiration? If influences there were, they could only have come upward and not downward, from French laws over the EC laws and not the opposite?
