Whatever the "action" refers to, I understand it as meaning that only the owner of the property can carry it out. So, the translation might read something like this:
"ownership of the property and (responsibility for) the scope of action are inseparable"....

Se ha insistido en base al principio de referencia al tipo en que el dominio del hecho o cualquier otro criterio no es un principio universal para determinar la autoría en toda clase de delito. También el dominio del hecho o cualquier otro criterio debe ser concebido como concepto abierto, que admite ser descrito y complementado por principio regulativo y no un concepto puramente indeterminado ni fijo, absoluto o abstracto.

"El concepto "correcto" de dominio del hecho sólo se habría encontrado si es utilizable como concepto general de autor. No existe otra prueba examinadora para establecer su adecuación. En la búsqueda del contenido del dominio del hecho, siempre está implícita la del concepto correcto de autor."1

El concepto restrictivo de autor encuentra su fundamento en la realización del tipo penal, por lo que para el criterio del dominio del hecho sólo puede ser autor o dominador del hecho la figura clave de los sucesos de actuación concretos que se muestran como realizadores del tipo penal.

Por otra parte, la jurisprudencia puede contar con otros criterios doctrinales acertados para determinar la autoría. El criterio de la >2, sustentado sobre el razonamiento de que la teoría de la autoría y la participación no sólo forma parte de la teoría del tipo, sino que está dentro de la imputación objetiva. La aplicación del criterio de la > es evidente en las consecuencias concretas de la teoría del dominio del hecho: dominio de la acción, de la voluntad y dominio funcional.
