Osim nedosledne primene evropske regulative, kod ovog Nacrta postoji problem usaglašavanja sa postojećim zakonima, ali i aktuelnim strateškim reformama u medijskom sektoru, što dovodi u pitanje mogućnost implementacije buduće Strategije razvoja medijskog sektora. Nacrt je tako (u odnosu na važeći Zakon) dodatno liberalizovao određene vidove oglašavanja na javnom servisu, počev od product placementa, krolova, komercijalnih emisija, komercijalnih priloga, podeljenog ekrana, interaktivnog oglašavanja itd, koji u aktuelnom zakonu čak ni ne postoje, iako se tokom aktuelne diskusije o Medijskoj strategiji razgovaralo o načinima uvođenja dodatnih ograničenja za oglašavanje na Javnom servisu.
