Tras el divorcio, cada uno de los cónyuges recobra el uso de su apellido. No obstante, si el demandante es el esposo y el divorcio se dicta por cese de la convivencia conyugal, la mujer tiene derecho a seguir usando el apellido del marido. En los demás casos, la esposa puede conservar el uso del apellido del marido bien con el consentimiento de éste, bien con la autorización del juez, siempre y cuando demuestre que ello entraña un interés particular para ella o para los hijos.
