absolute (non-delaying, pre-trial) defenc/se of unenforceability by going to court Explanation: I wrote an explanation that has disappeared, but peremptory contrasts with 'dilatory' that delays or holds up trial and asbolute contrasts with limited defences. In E&W law, only challenges e.g. for a juror or judge to stand down from a trial are 'peremptory'. Tom West III's AmE law dictionary: 'peremptory defense, defeats the action' (ab initio).
