The rules peculiar to donations inter vivos do not apply to a donation that is burdened with an obligation imposed on the donee that results in a material advantage to the donor, unless at the time of the donation the cost of performing the obligation is less than two-thirds of the value of the thing donated.

Darowizny, zobowiązania, potrzeba uregulowania spraw majątkowych – to kwestie pojawiające się najczęściej pod koniec życia.

Jednym z najczęstszych rozwiązań rozporządzenia swoim majątkiem jest wykorzystanie instytucji darowizny. Została ona opisana w art. 888 KC, który stanowi, iż przez umowę darowizny darczyńca zobowiązuje się do bezpłatnego świadczenia na rzecz obdarowanego kosztem swego majątku.



Czy jednak istnieje możliwość nałożenia na obdarowanego określonych obowiązków, celem zaspokojenia potrzeb osób trzecich?

Kodeks cywilny przewiduje dwie służące ku temu instytucje – darowiznę obciążliwą oraz darowiznę z poleceniem.

Pierwsza z nich nie została wskazana wprost w ustawie, jednakże zgodnie z art. 393 § 1 Kodeksu Cywilnego – jeżeli w umowie zastrzeżono, że dłużnik spełni świadczenie na rzecz osoby trzeciej, osoba ta, w braku odmiennego postanowienia umowy, może żądać bezpośrednio od dłużnika spełnienia zastrzeżonego świadczenia. Powyższe odnosi się również do umowy darowizny, w której zastrzeżono, iż obdarowany spełni określone świadczenie na rzecz osoby trzeciej. Na skutek tego obowiązku osoba ta staje się wierzycielem obdarowanego.
