the document form of acts in law Explanation: There are a number of translations which advocate "documentary form," but I am not convinced. ccccccccccccccccccccccccccccccccc Dokumentowa forma czynności prawnej 27 maja 2015 roku Sejm uchwalił ustawę o zmianie ustawy – Kodeks cywilny – Kodeks postępowania cywilnego oraz niektórych innych ustaw. Omawiany akt powoduje doniosłe zmiany w zakresie dopuszczalnych form czynności prawnych. Nowo dodane przepisy art. 772 oraz 773 kodeksu cywilnego wprowadzają instytucję formy dokumentowej czynności prawnej. Do jej dokonania wystarczające będzie złożenie oświadczenia woli w postaci dokumentu, w sposób umożliwiający ustalenie osoby składającej oświadczenie. Dokument natomiast zdefiniowany został jako każdy nośnik informacji, umożliwiający zapoznanie się z jej treścią. Nowelizacja zawiera także liczne nowe regulacje dotyczące dokumentów lub oświadczeń sporządzanych lub składanych w formie elektronicznej. | Reference: Forma dokumentowa czynności prawnych Reference information: Najnowsza nowelizacja Kodeksu cywilnego wprowadza nową formę dokonywania czynności prawnych – formę dokumentową. 10 lipca 2015 r. uchwalona została nowelizacja Kodeksu cywilnego, której przedmiotem jest m.in. ustanowienie nowej formy szczególnej dokonywania czynności prawnych – formy dokumentowej. Instytucja ta ma w założeniu przyczynić się do usprawnienia dokonywania czynności prawnych, a jej wprowadzenie stanowi odpowiedź na potrzeby praktyki. Nowe przepisy wejdą jednak w życie dopiero po upływie 12 miesięcy od ogłoszenia ustawy w Dzienniku Ustaw [czyli 8 września 2016 r. – publikacja nastąpiła 7 września 2015 r.]. Definicja dokumentu w Kodeksie cywilnym Nowelizacja wprowadza do Kodeksu cywilnego definicję dokumentu, zgodnie z którą dokumentem jest nośnik informacji umożliwiający zapoznanie się z jej treścią. Dotychczas definicję dokumentu zawierał jedynie Kodeks postępowania cywilnego, który wyróżniał dokumenty urzędowe oraz dokumenty prywatne. Żeby pismo zostało uznane za którykolwiek z rodzajów dokumentu, musiało być podpisane, chyba że przepis szczególny stanowił inaczej.
