Contributory negligence Explanation: Sin. is short for sinistro and concursuale refers to a car accident where the liability is divided among all the parties involved. The %resp. indicates how much one party contributed to create the accident -------------------------------------------------- Note added at 1 day 4 mins (2018-05-10 11:42:48 GMT) -------------------------------------------------- liability/accountability % is fine, "claim contribution" IMO isn't. https://en.wikipedia.org/wiki/Contributory_negligence The contributory negligence defense can potentially eliminate the defendant's responsibility to pay damages to an injured plaintiff. For example, a pedestrian crosses a road negligently and is hit by a driver who was driving negligently. Since the pedestrian has also contributed to the accident, they may be barred from complete and full recovery of damages from the driver (or their insurer) because the accident was less likely to occur if it hadn't been for their failure to keep a proper lookout. Contributory fault means more or less the same but it is mainly used in the settling of contracts https://www.merriam-webster.com/legal/contributory fault contributory fault n : responsibility for aiding in the accomplishment of a bad result (as an injury) ;specif : responsibility of a promisor for causing his or her promise to be impossible to perform |
