Ügyészi perbeszédben szerepel Brit angolban (pontosabban Skót angolban) fogom használni.

A mondat amiben szerepel: "arról is beszélek majd... hogyan lehet a vádlottak terhére rótt tényállást az *ítéleti tényállás* alapjául megállapítani."

Először én arra gondoltam, hogy ez a fogalom a "vádirati tényállás"-sal azonos, de viszont ez utóbbi is szerepel a szövegben mint fogalom.

A mondat : "Amiről nem fogok beszélni, a *vádirati tényállásban* szereplő eseményekről, számokról...."

Tehát szükséges-e különbséget tenni az "ítéleti" és "vádirati tényállás" között és ha igen, minek az alapján? Illetve használatosak-e szinonímaként?

Segítő, szakmai választ szeretnék kérni és nem rosszindulatú, gúnyolódó kioktatást. Előre is köszönöm.

Judging terminates in a decision or statement

3. The judgment when formed is a decision; it closes (or concludes) the question at issue. This determination not only settles that particular case, but it helps fix a rule or method for deciding similar matters in the future; as the sentence of the judge on the bench both terminates that dispute and also forms a precedent for future decisions. If the interpretation settled upon is not controverted by subsequent events, a presumption is built up in favor of similar interpretation in other cases where the features are not so obviously unlike as to make it inappropriate. In this way, principles of judging are gradually built up; a certain manner of interpretation gets weight, authority. In short, meanings get standardized, they become logical concepts (see below, p. 118).

It seems to me the core sense of fact is a statement [almost] everyone believes to be true, and/or the veracity of which can be repeatedly confirmed by direct observation / experiment. But it's a racing cert that at some point in the past, everyone believed the earth was flat, so we have to accept that facts are not immutably true or false. Leading to the somewhat tautological definition that a "fact" is any statement that most people currently consider to be a fact.
