payment of arrears Explanation: As the German pension has been increased, no claim for damages can be made against the arrears payment. The arrears will be paid to the widow. Perhaps this is an ongoing process of damages claim against a person, who has died during the process. The widow's pension cannot be subjected to these claims, I guess. |

Explanation: zu 1) Eine Nachzahlung bedeutet, dass sich der Anspruch auf Witwenrente (aufgrund der Neufestsetzung) rückwirkend erhöht hat und der noch nicht ausgezahlte Rentenbetrag nachträglich überwiesen wird. zu 2) Die Witwenrente kann offenbar mit der "deutschen Rente" aufgerechnet werden, denn laut Versicherer besteht ein Kausalzusammenhang zwischen Ersatzanspruch und Nachzahlung. Im Umkehrschluss: Wenn sich die deutsche Rente nicht erhöht hätte, wäre auf die Nachzahlung ein Ersatzsanspruch (der deutschen Rente) geltend gemacht worden, d. h. die Erhöhung der Witwenrente wäre durch eine entsprechende Verringering der "deutschen Rente" ausgeglichen worden. -------------------------------------------------- Note added at 2 Tage19 Stunden (2008-09-17 19:06:11 GMT) Post-grading -------------------------------------------------- Besten Dank! |
