"Damit der Käufer die Immobilie, zur Sicherung seiner Finanzierung mit einer Grundschuld bis zu einer bestimmten Summe belasten kann, wird häufig bereits im Grundstückskaufvertrag eine Belastungsvollmacht aufgenommen. Ohne diese Möglichkeit könnten die meisten Immobiliengeschäfte nicht abgewickelt werden, da eine Verschuldung über mehrere Jahre bei Immobilien heute eher die Regel ist als eine Ausnahme ist. Es ist verständlich, daß die finanzierenden Kreditinstitute des Käufers die benötigte Kreditsumme erst dann auszahlen, wenn Sie als Gläubiger im Grundbuch abgesichert sind. Meistens ist dies mit der Ablösung von Belastungen des Verkäufers verbunden. Und da der Verkäufer ein Interesse daran hat, den Kaufpreis vor der Umschreibung des Eigentums auf den Käufer zu erhalten, stimmt er der Belastung zu. Der Verkäufer wird dadurch abgesichert, daß der Käufer seine Ansprüche auf Auszahlung der Kreditsumme gegen das Kreditinstitut unwiderruflich an Ihn abtritt. "

O ile mi wiadomo, jedyną formą obciążenia nieruchomości - przynajmniej w PL - jest ustanowienie hipoteki.
