A. Arbeitsverhältnis
1. Ihr Verleiher muss eine Erlaubnis der Bundesagentur für Arbeit zur Arbeitnehmerüberlassung haben. Ihr Arbeitsvertrag ist unwirksam, wenn Ihr Arbeitgeber keine Erlaubnis besitzt und auch die Ausnahmen von der Erlaubnispflicht nicht zutreffen. In diesem Fall kommt es zu einem Arbeitsverhältnis zwischen Ihnen und dem Entleiher, und zwar ab dem Zeitpunkt, der zwischen Verleiher und Entleiher vereinbart wurde. Wenn die Erlaubnis im Laufe des Arbeitsverhältnisses wegfällt, muss der Verleiher Sie darüber sofort informieren. Der Verleiher muss Sie auf das voraussichtliche Ende der Abwicklungsfrist hinweisen. Die Frist zur Abwicklung des Vertrags beträgt höchstens 12 Monate. Unter Abwicklungsfrist versteht man die Frist, die dem Verleiher maximal bleibt, um mit dem Entleiher bereits geschlossene Verträge zu realisieren.
