Brokered contracts assumes the contracts themselves are 'agented' rather than ones for brokers to act as 'go-betweens'. Points to be made, rather than awarded in advance d.h. 'im Vorfeld': 1. the KudoZ term of service contract can probably be discounted from the outset 2. 'When in doubt, use intermediary (vs. middle(wo)man' or 'go-between') and intermediation. 3. as a rough rule of thumb, the 'rhyming' couplets in much of the English-speaking world are agency agreements vs. brokerage contracts 4, many lawyers and courts Transatlantically in general, and in the UK in particular, prefer the term of (often implied: prelim.) agreement to contract - the latter begging the question of a binding arrangement. In fact, over the years, my London translation office of old - as an agency - received constant requests from legal clients/ Solicitors' firms to change the term of contract to agreement, especially when litigation was afoot. 'He who pays the piper, calls the tune', plus the command was within acceptable parameters as a 'lawful order for a staff translator' to obey, whereas other requests - to change the meaning to suit the end-users' case - had not been.
