Technically, 'not' qualifies the verb assume, so some might feel compelled to translate this as follows:
'Even if one assumes, and we don't, that a breach of duty (had) occurred, the plaintiff still cannot claim damages because...'

I went ahead and hanged the relationships slightly in the target version because it looked like a more natural way of translating the concept while not sacrificing meaning.

  -> Sure. The prose is not exactly stellar. But I typically ignore that as long as I can recognize the communicative intent/Totally agree with your interpretation. Don't know what else it could possibly mean.
