Voici le contexte :

Article 5 : Garanties
Le concédant déclare que les redevances annuelles du brevet ont été régulièrement acquittées et qu’il n’a consenti aucune autre licence d’exploitation, ni aucune cession totale ou partielle, ni aucun droit de gage ou nantissement sur le brevet et/ou la marque du contrat à aucune personne physique ou morale.
Le concédant ne donne au licencié aucune autre garantie que celle ***de son fait personnel*** et de l’existence matérielle du brevet et de la marque.
Le licencié reconnaît avoir pris connaissance de l’ensemble des documents et informations relatifs au brevet et à la marque et déclare être pleinement informé quant à leurs disponibilités et validités.
