Grazie alla disponibilità di Emanuela sono riuscita a trovare una formulazione per la spiegazione più adeguata:

il fatto è che nella traduzione dei brevetti l'aggiunta di un termine, tanto più se codificato nel linguaggio brevettuale, rispetto all'originale è considerato un errore grave anche se migliora notevolmente l'esposizione della frase.

il concetto di prassi porta già in sè il principio di "abituale"
