French term or phrase: ne constituent pas une infraction

In der Begründung der ausländischen STA auf eine aus D stammende EEA heißt es:

Attendu que:
....
"... que les faits **ne constituent pas une infraction** en vertu du droit (Vollstreckungsstaat)
..."

Weiterer Kontext: Der Vollstreckungsstaat stimmt ohne weiteres der Vollstreckung der EEA zu.
Eine Zustimmung erfolgt aber doch nur dann, wenn die strafbaren Handlungen auch im Vollstreckungsstaat zu ahnden sind - wieso dann die "Verneinung"?

Hat da die ausländische STA im Vollstreckungsstaat die Übersicht über das Baukastensystem verloren und vergessen, die Verneinung zu löschen - oder liegt es an meinem Unverständnis des Satzes?
