depositary services agreement Explanation: Maybe too late for the asker, but for future reference: In an EU fund context, prefer 'depositary' (not 'custodian' and NOT 'depository') to translate the cognate word in French. See the linked article for the crucial differences between depositary and custodial functions. See also the various UCITS and AIFM Directives in English. In practice, fund depositaries commonly delegate actual custody (FR conservation) to other institutions and retain mainly their more legal functions, which cannot be delegated. This makes them similar to what are called 'fund supervisors' in parts of the Anglosphere. 'Depositary' is an established term in the US as well, in terms such as ADRs and as defined in the securities law chapters of the US Code -- if not in the exact same fund context as here, still always for one entity acting as agent for another.
