The following sentence appears on a 'declaration de nationalite francaise' document.

Après avoir justifié de leur identité, les époux attestent sur l'honneur que la communauté de vie
subsiste entre eux depuis Ie mariage.
My attempt to translate is 'After having justified their identity, the spouses declare on their honor that the certificate of cohabitation subsists between them since the marriage'

And again another sentence for context:
"La cessation de la communauté de vie centre les époux dans les douze mois suivant l'enregistrement de la déclaration prévue à l'article 21-2 constitue une présomption de fraude"
Translation attempt: The termination of the certificate of cohabitation between the spouses within twelve months of the registration of declaration provided for in Article 21-2 which constitutes a presumption of fraud.

Is it correct to say a certificate of cohabitation or is there a better legal term?

There is not necessarily any actual "certificate of cohabitation" as such — in plain language, it just means 'they have [in fact / actually] been living together'

Sorry, I don't know how to express that in more formal, legal language!

It is referring to the actual fact of really living together.

Définition de communauté de vie
La communauté de vie est un terme juridique renvoyant à l'un des devoirs des époux durant le mariage. La communauté de vie est prévue à l'article 215 du Code civil et fait référence à deux obligations distinctes. D'une part, l'article 215 alinéa 2 du Code civil impose aux époux de partager une communauté de vie dans une résidence. Cela signifie que les époux s'engagent à disposer d'une résidence commune. Ceci ne les empêche cependant pas d'avoir des domiciles distincts. D'autre part, la jurisprudence envisage la communauté de vie sous l'angle de la cohabitation charnelle. Ce point signifie que les époux s'engagent à entretenir ensemble des relations sexuelles à un rythme régulier. Le non-respect de chacune de ces deux obligations peut constituer une faute justifiant aussi bien le divorce que l'allocation de dommages et intérêts
