La théorie de l'imprévision prévoit que, dans le cadre de l'exécution d'un contrat administratif, le cocontractant de l'administration doit poursuivre l'exécution du contrat même si survient un événement imprévisible et temporaire qui la rend plus difficile. Il aura droit à une indemnisation partielle du préjudice qui lui est causé. Rejetée par le juge judiciaire, cette théorie est en principe acceptée par le juge administratif français.
