جلسة تحضيرية Explanation: الجلسة التحضيرية هي جلسة يتمّ فيها تبادل الوثائق كتابيا بين الأطراف عن طريق المحامين و لا يقرر القاضي أي شيئ. يمكن أن تكون هناك عدة جلسات تحضيرية لتبادل الأجوبة كتابيا عن طريق إيداع المستندّات المضاضة. الجلسة التمهيدية تعني أنّ القاضي أمر بشيء يرجّح كفة متقاضي عن كفة الأخر و بالتالي تعني أنّ الحكم النهائي سيتجه لصالح طرف معين. راجع الفرق بين الحكم التمهيدي و الحكم التحضيري في الرابط الأول المشار إليه اسفله لا يمكن القول بحكم تحضيري في جلسة تحضيرية بل هو إجراء تحضيري محض ومحايد يرمي فقط لتنوير العدالة عكس ذلك يمكن التحدث عن حكم تمهيدي في جلسة تمهيدية لأنه إجراء أو أمر ببحث يرجّح كفة حقوق متقاضي على حساب خصمه و ينذر بطبيعة الحكم النهائي الذي سيصدر في ما بعد والله أعلم https://alqabas.com/119409/ https://ouledattia.yoo7.com/https://ouledattia.yoo7.com/t1712-topic-topic https://www.village-justice.com/articles/Procedure-mise-etat,17620.html |
