Explanation:
With regard to actions, esteetön means unhindered, e.g. esteetön kauttakulku, unhindered transit. Regarding marriage or other legal actions, esteetön means without impediment or competent e.g. esteetön todistaja, a competent witness.
Esteellinen means disqualified, or in the context of a justified absence, having a lawful excuse. Jäävi is used for disqualified when a bias or vested interest exists which could prejudice a vote.

Asker: So can I say, counsel was either competent (which was my orignal suggestion) or disqualified?

agree  Timo Lehtilä: 'Esteellinen' and 'jäävi' are often quite synonymous, but in your example "The charged was..." only 'esteellinen' is possible.
