English term or phrase: to borrow from the other
I'm translating a post-nuptial agreement. One of the sections reads as follows:

''3. Nothing herein contained shall be deemed to prevent either party from instituting a dissolution of marriage or from maintaining any other action for absolute dissolution of marriage against the other in any jurisdiction, nor to borrow from the other defending any such suit. However, in any action, the Final Judgment shall incorporate the terms of this agreement, and the parties shall be bound by all the terms of this agreement, it being understood that, to the extent this contract covers, it is always subject to the continuing jurisdiction of the proper Court.''

I don't really understand the meaning of this phrase in this particular context. Am I right in thinking that ''nor to borrow'' refers back to ''shall be deemed to''?

Any help would be greatly appreciated.
