licence vs. lease agreement

u ugovoru je rijec o koriscenju poslovnog prostora

LEASE. A lease is an agreement in which the landlord agrees to give the tenant the exclusive right to occupy real property, usually for a specific term and, in exchange, the tenant agrees to give the landlord some sort of consideration. A lease transfers to the tenant a leasehold interest in the real property and, unless otherwise provided in the lease, a lease is transferable and irrevocable.
LICENSE. A license gives the permission of the owner to an individual or an entity to use real property for a specific purpose. Unlike a lease, it does not transfer an interest in the real property. It is personal to the licensee and any attempt to transfer the license terminates it. It is (usually) revocable and can be either exclusive or non-exclusive.

Ipak treba konsultovati pravnike, ali moje mišljenje je da kod nas postoje posebno termini:
zakup i linzing

Mislim da je kod nas jednostavno prihvaćen poseban termin "lizing" pa čak i termini "iznajmljivanje uz lizing", "kupovina na lizing""ugovor o lizingu" i sl. da bi se naglasila razlika između klasičnog zakupa i lizinga koji se koristi kao "pomagalo"u slučaju nedostatka novca za kupovinu opreme ili poslovnog prostora i gdje postoji i mogućnost otkupa odnosno promjene vlasnika,a što nije slučaj kod klasičnog ugovora o zakupu.

disagree  Daryo: a "licence to occupy" is not a lease nor a tenancy agreement - As fas as I know there's simply no equivalent in the laws of any ex-YU states. Good luck with this one! // also no connections with financial leasing
