Да я не против того, чтобы, скажем, fixed perpetuity period of 80 years (см. ссылку ниже) считать "бессрочным". Действительно, 80 лет - это много. Про 125 и не говорю. :-)

"предельный срок" Я все-таки голосую за бессрочное владение:

1) Буквальный смысл слова "perpetuity" именно такой;
2) "предельный срок" устанавливается правилом ИСКЛЮЧЕНИЯ (rule AGAINST) "perpetuity"
3) судя по ссылкам в интернете, перевод "perpetuity" как "бессрочное владение" уже принят и спользуется в русских текстах на тему английских трастов.

A statutory scheme for the rule was later added to the existing common law system (see the Perpetuities and Accumulations Act 1964). The rule sets a time limit (known as the perpetuity period) within which future dealings with property (such as gifts to a particular child, or a group of people who fulfil a particular condition) must occur. Иными словами, правовая норма устанавливает срок (sets a time limit). Если же написать про "бессрочное владение", то получается, что срок не устанавливается ("без срока"), а это не так. Нет?

Имхо, высказался бы за "предельный срок", поскольку, как мне кажется, слово "бессрочный" указывает на неограниченность срока, тогда как на самом деле срок-то ограничен, не так ли?

An important aspect of the legal system of England and Wales is that property cannot be tied up in trust for an indefinite amount of time and future interests in property must take effect within what is called the perpetuity period. In practice, at the end of that perpetuity period, the trustees' dispositive powers cease, the trust comes to an end and the trust property is held according to the default provisions i.e. the future interests vest. The Perpetuities and Accumulations Act 1964 (the ‘1964 Act') allowed testators and settlors the opportunity to choose a fixed perpetuity period of 80 years, but the common law ‘lives in being' option was still available. The 1964 Act also placed a restriction of 21 years on the length of time that income can be accumulated as part of capital within a trust.
