2.2 Parties that can apply to open proceedings

Depending on whether the application for insolvency proceedings is lodged by the debtor or by the creditors, the requirements for submission vary.

If insolvency proceedings are applied for by the debtor (voluntary proceedings), it must justify before the court that it is currently insolvent or will be so imminently; that is, that it cannot pay its liabilities on a regular basis. If the insolvency is current, the debtor is obliged to apply for insolvency proceedings within two months from when it becomes aware or should have become aware of its insolvency.

neutral  Cristina Mantovani: Essa divisão entre ‘contencioso’ e ‘não-contencioso’ se dá somente em direito tributário e administrativo (curiosidade minha)? Pois normalmente se usa processo (de jurisdição) contenciosa/voluntária, não?
