Termen er hentet fra følgende setning: "The Company may at any time, including but not limited to the whole or any part of any notice period, require you not to attend work at any of the Company’s offices; this leave of absence being referred to as “garden leave”." In response to Per's disagree: If you read further down in the same ref, it reads:
"In accordance with Clause 1.11 of your contract, you are hereby placed on garden leave for the remainder of your notice period. During this period, you are not permitted to work for any other person, firm, client, corporation or on your own behalf without the Company's prior written permission. You will continue to receive your contractual pay and benefits during this notice period and whilst you remain on garden leave.

Furthermore, in accordance with Clause 1.13 of your contract, the Company hereby notifies you that with effect from the end of your notice period, you will be placed on a further quarantine period, up to a maximum of 12 month." Note the phrase "*further quarantine period*". The purpose of GL is not only to protect a company from angry employees, but also to prevent them from going over to work for a direct competitor.

Here's another definition: "The term, “garden leave injunction”, is generally used to describe the range of orders which a
Court may make to protect an employer when an employee is seeking to leave to join a competitor. Used in its purest sense, it describes the situation where the Court makes an order effectively putting an employee into quarantine for the whole or some part of the period of notice due under the contract."

In short, I would say that "garden Leave" is a euphemistic term for quarantine.

Having said the above, I do agree that your term, "lønnet arbeid" would be a more appropriate solution here, Per. Having looked at this again, I think "karantene" is too blatant here.

Tror dette er det nærmeste en kommer. I praksis er garden eller gardening leave å utestenge en person fra arbeidet i oppsigelsestiden, og sannsynligvis i strid med Arbeidsmiljøloven på flere punkter - men permisjon med lønn vil som regel være godtagbart dersom selve oppsigelsen er det...

Mange gode forslag her. Arbeidsfritak kunne vært ett, hvis det ble formulert som 'tvunget arbeidsfritak' eller 'pålagt arbeidsfritak'. Karantene er imidlertid en periode som begynner å løpe etter at et oridinært arbeidsforhold tar slutt.
Hvis jeg slutter i Dagbladet for å begynne i VG, kan Dagbladet bestemme at jeg må forlate jobben straks. De betaler meg likevel ut oppsigelsestiden. Dette er garden leave
Hvis jeg tar en sluttpakke i VG, kan denne inneholde en karantenetid som gir meg redusert etterlønn hvis jeg tar en annen jobb i Schibsted-konsernet i etterlønnstiden - noe som ville ha gitt meg dobbel lønn.   -> De som utsettes for permitteringer håper nok det. Selv etter en oppsigelse vil man gjerne ha en førsterett dersom nye jobber blir ledig. Garden leave handler om et annet fenomen, nemlig utsestengelse fra arbeidsplassen med lønn.

disagree  Per Bergvall: Din egen referanse viser at dette blir galt. Garden leave er nevnt under termination of emplyment; quarantine er et annet og påfølgende punkt. GL er en fysisk utestengelse, oftest i forbindelse med oppsigelse, for å beskytte bedriften mot sinte ansatte.
