Apologies, I was reading the sentence as if it was the title of the document, thus, my previous suggestion connected with the hearing.

Now, reading it again, I think it is better to stick to the definition given by Wordreference which is the core of the issue. I would then describe it only once or twice at the beginning of and throughout the text depending of the importance as:

determinare il diritto dil studente di rimanere nella sua attuale posizione (Texto originale inglese: "Pendency")

When you insert 'Pendency' in brackets and use inverted commas, then it is like using a term in contracts in the sense of 'hereinafter called "Pendency" and then use only 'Pendency' instead of the whole definition and you don't have to explain it every single time.

Si è svolta un'udienza imparziale il xxx per determinare il diritto dil studente di rimanere nella sua attuale posizione (Texto originale inglese: "Pendency")

I have now changed my answer accordingly.

Thank you! In the text the term Pendency occurs not only related to the Hearing but also as a stand-alone term, like "the District did not oppose pendency" or "The Attorney stated that the pendency request was based on...". In this case should I translate Pendency as Determinazione dello stato per l'istruzione, or better as Diritto di rimanere nell'attuale posizione di studente? Thank you for your help
