disagree  Daryo: "renonciation au droit d'exiger de l'autre partie de remplir ses obligations" et non "renonciation aux obligations" // on peut renoncer à ses droits, je ne vois pas très bien comment on peut "renoncer à des obligations contractuelles"

"waiving" doesn't imply explicitly / actively allowing the other party to ignore some of its obligations, it's more a passive response (or lack of it, more precisely) - failing to react, so "tolérance" sounds appropriate.
