Je penche pour l'avis de Tony dans la mesure où pour qu'une marque soit considérée d'un point de vue légal il faut au préalable procéder à son dépôt.

Je vais donc m'orienter sur cette qualification d'enseigne qui me semble particulièrement appropriée.

The problem is that in FR, we tend to use the same word for both!

Brand is 'marque', but often with the sense of 'enseigne' — when the 'brand' is in fact one company, like say 'Carrefour'; very often, it is also the manufacturer, in which case we might also call it 'make'; "What make of car do you have?" "What brand of washing-powder do you use?"
Mark is often used to refer specific product ranges within a given brand; so the 'Leclerc' supermarket brand includes marks like 'Marque répère' etc.; it may of course be that 'mark' relates in a legal sense to 'trademark' or 'service mark', in which case 'marque déposée' may well be the right term to use.

Basically, you need to look at each individual case on its merits and choose the term accordingly.

In purely heirarchical terms, a 'brand' may have sub 'marks, but a 'mark' does not have sub 'brands'.
