27.3 Section 11 of the Appellant ' s Notice and the Order of Mr Justice made on 2 April 2019 in which he granted Mr XX permission to pay the cost award (amounting to £30,579.75) due to YY following the First Instance Judgment into Court pending the outcome of Mr XX's Appeal ("Payment In Order") (see pages ***). One of the reasons that Mr Justice provided in the Payment In Order for the order having been made was because there was "compelling evidence that if the Appellant paid the Respondent pursuant to paragraph 5 of the Order, and the appeal was then successful, the Appellant would not be able to recover the costs paid cover.

…l’ordonnance rendue le 2 avril 2019 par laquelle le juge donne à M. XX la permission de consigner [à la cour] [au greffe de la cour], en attendant l’issue de l’appel déposé par M. XX, les dépens (qui s’élèvent à 30 579,75 £) [dus] [adjugés] à YY en vertu du jugement de première instance (la «consignation du paiement») (cf. pages ***). L’une des raisons pour lesquelles le juge a accordé la consignation du paiement dans l’ordonnance rendue est qu’il y avait «preuve [probante] [concluante] [péremptoire] que si l’Appelant payait l’Intimé aux termes du paragraphe 5 de l’Ordonnance et qu’il avait ensuite gain de cause en appel, il serait incapable de recouvrer la garantie des dépens payée».
