English term or phrase:contentious date
Beste collega's, ik zit te worstelen met de term "contentious date" (omstreden datum? controversiële datum?) in de volgende definitie in een verzekeringspolis: "The contentious date is the date which is mentioned in the insurance letter plus 14 days when the customer has not paid the insurance installment/premium." Duidelijk WAT het is, maar is hier ook een specifieke Nederlandse term voor? Bedankt!!
Ik zou de klant om opheldering vragen. De term is niet gangbaar in het Engels (het werk van een dilettant?). Contentious date klinkt als betwiste datum, maar uit de tekst blijkt niet dat de datum wordt betwist. In tegendeel: de contentious date valt 14 dagen na de datum waarop de premie betaald had moeten zijn - dat lijkt mij niet voor betwisting vatbaar. Verderop in de tekst staat bovendien: '(...) he/she has to calculate the contentious date of the insurance and has to enter this date' => een betwiste datum wordt niet berekend. 'Betwistbaar' lijkt me ook onwaarschijnlijk - dat zal een verzekeraar toch niet in zijn polissen opnemen. Het is duidelijk de datum waarop iets gebeurt of in gang gezet wordt/mag worden, maar uit de tekst wordt niet duidelijk wat. Gerechtelijke procedure? Annulering? Beëindiging van rechtswege? Royement? Welke vertaling je ook kiest, volgens mij blijft het een gok omdat je niet weet in welke context die contentious date uiteindelijk gebruikt gaat worden. Met wat uitleg van de klant kunnen we er misschien iets zinnigs van maken!
Ik krijg de indruk dat 'contentious date' hier (in een polis) een beetje vreemd gebruikt is. (In bijvoorbeeld processtukken zou het denk ik gewoon 'betwiste datum' betekenen.)
Daarom ben ik het helemaal met je eens: juist omdat de term in de brontekst gedefinieerd wordt, heb je heel veel vrijheid om zelf een term te bedenken (als er geen standaardbegrip voor is natuurlijk). De definitie komt er immers achter.
Vandaar mijn (serieus bedoelde) suggestie: contentiedatum, d.w.z. de datum van contentie. In een andere situatie zou ik zoiets niet snel voorstellen, want het heeft nul (0) googlehits en 'contentie' is een verouderd woord...
Ik kan niet goed beoordelen of je opmerking sarcastisch was ('als we dan toch zelf iets vrijs mogen verzinnen'), maar voor de duidelijkheid: wat ik bedoel is dat aangezien dit een lijst met definities van deze specifieke onderneming is, Karen volgens mij niet op zoek hoeft te gaan naar specifiek jargon.
Ron, Dat klinkt mij iets te "blij" :-) Michael: voetnoot is mscchien wel een idee, al wordt in de eigenlijke zin natuurlijk al een definitie gegeven. Contentieuze datum heeft denk ik wel mijn voorkeur (met definitie in de zin).
Dat is wel wat het is, maar als titel is het vrij lang (en wordt waarschijnijk ook gebruikt in computerprogramma als naam van een veld). Zoeken nog even verder...
Als er geen specifieke term voor bestaat, ga ik er nog eens goed over nadenken, heb gelukkig wel wat tijd nog. En nee, het is de handleiding voor het opstellen van de polis. Bedankt Sindy, mocht je nog iets te binnen schieten deze dagen, hoor ik het graag. En natuurlijk iedereen bedankt voor het meedenken!
Vziw is er geen vaste term voor. Als de Engelse term voorkomt in de 'definities', opgesteld door de verzekeringsmaatschappij, dan heb je m.i. redelijk veel vrijheid wat een vertaling betreft.
Later nog een keer: "When *** receives the information from the insurance company that the customer has not paid the insurance premium he/she has to calculate the contentious date of the insurance and has to enter this date." Niet echt veel meer informatie dus.
Sindy, dit komt idd beter in de buurt, en de weigering tot uitbetaling van schadevergoeding zou dan de legal action kunnen zijn, of in de meeste gevallen het vervallen van de polis (en dus onverzekerd). Dat maakt voor de vertaling niets uit, meer context heb ik niet. Maar hoe heet toch die datum in het Nederlands? :-/
Hi Michael, I think you are right. The "datum ingebrekestelling" would be the date that is mentioned in the insurancce letter. The "contentious date" would be the date 14 days after that date, when the insurance company will or can take legal actions, as in a dispute? That would make sense. It gives the client an other two weeks before the company undertakes legal steps.
There are no set timescales for claims. Generally, a straightforward, non-contentious claim can take 2-3 months to be settled. More complex and hard fought claims can take longer. I think you might find the answer by looking into the term 'contentious' in a legal context. You might want to research terms such as: contentious and non-contentious insurance and contentious and non-contentious law

I have never heard of ‘datum ingebrekestelling’ (date of service of default notice) being referred to as the/a ‘contentious date’. Can we have a little more context?

Reference information: Het lijkt me niet onwaarschijnlijk (ik zeg het met de nodige voorzichtigheid) dat de contentious date verwijst naar de datum waarop/vanaf wanneer de verzekeringsmaatschappij het recht heeft/zich het recht voorbehoudt om schadevergoeding te weigeren dan wel de verzekering te annuleren o.i.d. als de premie op die datum nog niet is betaald.

Ik gooi een goed Nederlands alternatief nog even in de peinsprut, maar voor vandaag geef ik de pijp aan Maarten, dus ik hou het voorlopig bij een mogelijke interpretatie van de term (met erg veel slagen om de arm).
