yes, you're right. every context with it's own use.
however, in your context active voice would sound better, or it doesn't matter as I mentioned above.

There are gazillions of cases where passive would sound much better. Forcing everything into the active voice can have ridiculous results in certain types of writing.

not to mention that nobody expects EU documents to be examples of stylistic perfection.
It does make the sentence shorter.

I don't particularly like "appear" much (prefer my own suggestions), but don't think it's incorrect (as per writeaway's neutral). I don't think the Belgian Dutch term "hernemen" has a specific enough meaning for "appear" to be wrong.

Also agree with writeaway that there is absolutely nothing wrong with the passive voice. That's just something certain English teachers, and maybe MS Word's grammar checker, used to insist on.
