If you feel it fits better, you could use some other synonym for 'toestand' such as 'state' or 'position' but it's much of a muchness.

agree  Lianne van de Ven: I can't say this sounds like straightforward Dutch to me. Maybe it's from a legal document from one of the Dutch territories in the Caribbean? In NL we would say 'in overeenstemming met' (de situatie) or possibly 'naargelang de situatie'.
