samenloopverbod exclusion of concurrence Explanation: I think you might have to give a description: "In both systems, concurrence of contractual and non-contractual liability is excluded; article 1382 Civil Code is inapplicable when the fault was committed in the execution of a contractual obligation. In case, the breach is also a criminal act, an action in tort remains possible. However, tort liability is only relevant in case of damages to a third party or where services are rendered to a patient who is not in the position to give consent to the treatment." http://is.gd/DIlbPw "Naast een onrechtmatige daad tussen contractspartijen (samenloop) is het ook mogelijk dat contractuele wanprestatie schade toebrengt aan een derde.

Reference: samenloopverbod, concursus and interpleaders Reference information: "verbod" here is a "prohibitory" injunction, although to add "prohibitory" as a qualifier would be rather redundant by definition of injunction. samenloop = "concursus" or interpleader. http://definitions.uslegal.com/c/concursus/ http://www.asil.org/ilib0232.cfm http://law.justia.com/codes/louisiana/2006/181/74328.html http://is.gd/kbPhTZ http://is.gd/7zVckH What's probably about to happen is despite other claims for *perhaps* some breach of contract with respect to multiple parties to an agreement, the claimant has ascertained that the concursus injunction -- which bars multiple suits from being brought by various parties for, perhaps, the same problem -- does not apply in this matter, and he/she therefore wishes to exercise his/her right to sue individually. Not sure how this fits but... "concursus injunction" and "interpleader injunction" do not seem to be all to strange of terminology. Just hoping this reference info can help you along the way. I haven't much certainty at all what is truly correct. |
