...is almost always either intentieverklaring or -overeenkomst and "schriftelijk" in form – often binding & in some cases unilateral. "Afspraken", however, are typically "mondeling" IMO and mutual(ly agreed), but aren't always binding like overeenkomsten. Sure, you can draw up a written document based on those "afspraken" and call it an (al dan niet bindende) overeenkomst, but I wouldn't call it either of the terms to which you are leaning. The way I read it, "afspraak" refers to one specific line item of the collective bargaining agreement, more specifically, the "mutual intention" (literally wederzijdse intentie) to pay x.xx times the statutory transition fee/payment if/when the parties to the CBA have determined that the program is a success.
