Kuptimi i fjalisë është i tillë: nuk ka pse të marrë kompania e sigurimit përsipër tagrin gjykimor në rast mungese të vullnetit të kundërt, pasi ky tagër i takon gjykatës. Atëherë përse del nevoja për tagër gjykimor, kur nuk ka mosmarrëveshje/kundërshtime mes palësh???

I agree, that's exactly how I read it too (hence my original dilemma: does it make sense to say "lack of opposing wills" or "opposing wills"). As I have put it in a note in Klemi's answer, this simply implies that there would be no disagreements between the parties, which just throws off the whole "warranty-activiting" claim. I wanted to see if there was a different interpretation of this in the given sentence, but so far everyone seems to be thinking in the same lines as my original one.

Hi Ledja, it may also be that the writer wanted to say "in case there will not be any opposing wills from the parties". That is what I understand by reading this, indeed poor Albanian, text.

I feel your pain. I experienced the same thing in December. I spend a lot of time translated from Albania to Albania before I did the real translation. It happened that the client was a very nice one and he paid me for the time I spend on editing and revising Albanian material. Actually, they used my version as the original. Good luck.

Hi, Klemi. The case follows the termination of a sub-concession contract (involving the leasing out of certain premises) and one party claims that the Warranty (which is a payment in their favour, basically) should have been triggered since the other party was the one to breach the terms. Now, I've been entertaining the thought that the "writer" meant to say something like "në mungesë mirëkuptimi/marrëveshje midis palëve" and changed his/her mind mid-way and put "në rast vullneti të kundërt" without revising the sentence. The client has had a list of translator's footnotes from me on this series of documents, due to poorly written sentences, and that list will probably keep getting longer :).

Sometimes, the Albanian written materials are very confusing. I expect to get confused from any kind of material in English but not in my native language. Anyway, don't you think that with "ne mungese te nje vullneti te kundert te paleve "they are trying to say "with the absence of the party that can be affected...and has an opposing will, ..." My question is: "What kind of parties do we have in the contract?" Probably this kind of contract requires a party with opposing will. I am just throwing some ideas. Just ignore them if they are not helpful. You have the contract in front of you and you understand it better.
