original instruction manual Originalbetriebsanleitung / Übersetzung der Originalbetriebsanleitung Explanation: Bei diesem Thema kommt es häufig zu Missverständnissen. Kurz gesagt kommt es darauf an, ob die Übersetzung vom Hersteller besorgt (und geprüft) wird (--> Originalbetriebsanleitung) oder der Inverkehrbringer unabhängig vom Hersteller eine Übersetzung anfertigen lässt (--> Übersetzung der Originalbetriebsanleitung). Hier noch ein Zitat aus dem "Guide to application of the Machinery Directive 2006/42/EC", an dem es recht gut deutlich wird: "Machinery must be accompanied by original instructions, that is to say, instructions verified by the manufacturer or his authorised representative. If original instructions are not available in the language(s) of the Member State in which the machinery is placed on the market and/or put into service, machinery must be accompanied by a translation of the original instructions together with the original instructions." -------------------------------------------------- Note added at 53 mins (2020-03-23 12:50:27 GMT) -------------------------------------------------- Fehler sind natürlich nie 100% auszuschließen. Nach meinem Verständnis der Maschinenrichtlinie (bzw. dem Application Guide, siehe oben), muss der Hersteller gleichwohl auch für von ihm beauftragte Übersetzungen gerade stehen. Zur Minimierung des Haftungsrisikos taugt der bloße Verweis auf die Übersetzung kaum. Vielmehr dürften hier die angesprochenen Qualitätssicherungsmaßnahmen und "sauber" gestalteten Prozesse ausschlaggebend sein. Wenn man sich an der ISO 17100 orientiert, dürfte man diesbezüglich schon recht gut aufgestellt sein. |
