English term or phrase: Possesor vs. holder
A member state shall initiate the return proceedings for an unlawfully removed cultural object within three years after becoming aware of the location of the object and of the identity of its possessor or holder. There is a 30-year time limit overall, which starts at the moment of the unlawful removal of the object. This time limit, however, does not apply to cultural objects forming a part of public collections and objects belonging to religious institutions. For such objects, the limitation period is inspired by the 1995 UNIDROIT Convention and is 75 years or more.
