Denomina-se compra e venda o contrato bilateral pelo qual uma das partes (vendedor) por meio de oferta se obriga a transferir o domínio de uma coisa à outra (comprador), mediante a contraprestação de certo preço em dinheiro. O Código Civil o enuncia desta forma: “Art. 481

A propriedade pode ser compreendida, em seu conceito clássico, como o poder jurídico atribuído a uma pessoa de usar, gozar e dispor de um bem corpóreo (coisas móveis e imóveis) ou incorpóreo (direito autoral e direito de crédito) em sua plenitude e dentro dos limites estabelecidos na lei, bem como reivindicá-lo de quem injustamente o detenha. Nesse sentido, para a doutrina clássica, a palavra domínio representaria a propriedade que seria exercida sobre bens corpóreos; enquanto a palavra propriedade seria muito mais ampla, porque diria respeito à titularidade exercida sobre bens corpóreos e incorpóreos.

Two different verbs are used in BrE for lifetime transfers vs. transmission of property on death e.g. by testamentary disposition or on intestacy.

PS a City of London firm of Notaries objected - for notarial attestation (certification) - a dual translation for a single word and asked me 'to make up my mind' - to which I retorted that they should look to their professional indemnity policy in case of professional negligence claimed by disappointed lifetime transferees or Willed beneficiaries,

  -> Yes. You are right, though 1. I wanted to highlight the transfer vs. transmission dichotomy and 2. there is still a residual prospect of the Donee of the Power reserving a testamentary disposition of the title.
