A commission-only sales job or opportunity as we prefer to call it, is a mutually beneficial partnership between a company Principal and a self-employed sales agent, manufacturers rep or sales agency where the agent and company have a contracted working relationship but on very different terms to that of an employee.

- a (sales) job

FIRST - it's in actual fact a "job" as any other job (= "посао" у смислу запослити некога, не посао = "business"), meaning the "commission-only salesmen" (or saleswomen) are working exclusively for the employer, in the premises of the employer, in the hours fixed by the employer, using the employer's equipment, following (more or less strict) employer's instructions regarding the authorised sales pitch, etc ... (hardly what would could be seen as an "independent agent" ...)

- "commission-only"

the only small difference from "real/regular" employees is that there is no "salary" whatsoever - not even some guaranteed base salary / guaranteed minimum. The only remuneration offered is in form of "commission" (= "провизија") paid depending on the volume of concluded sale contracts (or even only on what buyers have effectively paid) thus the designation of the job as being "commission-only".

Basically, it's a nice piece of legal hokus-pokus used to employ sellers and shift ALL the risk of time wasted on unsuccessful sales on the employees themselves, NOTHING to do with real "independent agents". (as would be the ones doing what is called "комисиона продаја" and is a completely different legal arrangement)

• 1. Pojam komisionog posla

• Komision je takav privredni posao u kome se jedna strana obavezuje da će izvršiti neki privredni pravni posao u svoje ime a za račun druge strane, a druga će joj strana za to platiti. “Ugovorom o komisionu obavezuje se komisionar da za naknadu (proviziju) obavi u svoje ime i za račun komitenta jedan ili više poslova koje mu povjerava komitent” (član 771 ZOO). Sličnu , mada užu, definiciju sadrži i član 15. Zakona o trgovini (Sl.n. FBiH, 2/95): “Ugovorom o komisionu smatra se naročito prodaja ili kupovina robe u svoje ime, a za račun komitenta”. Po svojoj pravnoj prirodi, ugovor o komisionu je ugovor o nalogu (član 772 ZOO). Stoga se na njega primjenjuju odredbe ZOO naloga (član 749 - 770), “ako pravilima o komisionu nije drugačije određeno” (član 772 ZOO). Prema sistematizaciji Zakona o trgovini, komision pripada trgovinskim uslugama (član 11).

• Komision su usvojila sva moderna prava. U savremenim sistemima ovaj posao ima sličnu pravnu i ekonomsku fizionomiju. Prava i dužnosti stranaka povodom ovoga posla su u kontinentalnim sistemima više ili manje jednako regulisana. *****U anglosaksonskim porecima ovaj posao se pojavljuje u pravnom obliku prikrivene agencije (undisclosed agency)*****

The key difference:

the defining characteristic that makes a contract "ugovor o komisionoj prodaji" is that the agent (=komisionar) is acting "in its own name" meaning the other party has no idea whatsoever that there is a principal, (or who the principal could be) i.e. that the the seller is just an agent.

OTOH

someone who's got a "commission-only sales job" is definitely NOT selling whatever they are selling "in their own name" - they ALWAYS clearly state on whose behalf they are trying to flog their wares.
