O réu foi acusado de vários crimes. Após descrever um dos crimes, a sentença judicial passa para descrição do próximo crime, abrindo com a seguinte frase:

"Com relação ao crime de estelionato, melhor sorte não assiste ao réu."

ou p. ex.:

"Com relação à questão de fundo, melhor sorte não assiste ao recorrente."

ou...

"Todavia, desacolhida a preliminar suscitada, o que se aduz por mero apego ao princípio da eventualidade, no mérito, melhor sorte não socorre ao Apelado."

Trata-se de uma fórmula bastante comum em sentenças judiciais brasileiras. Procuro uma solução em inglês que soe natural.

if the appeal in the matter of fraud is also dimissed and flatly rejected for lack of merit on a questão de fundo > root question (ENG law of evidence: the ultimate issue), the defendant or respondent (US Am: appellee) will not be 'in for' any relief.
