execution (proceeding to levy) creditor

Explanation:
procedere a un'esecuzione forzata > to levy execution: Garzanti.

Maybe there is a main creditor precipitating the concordato as a result of trying to enforce a judgment debt.

Quaere: bankruptcy court for AG procedente in the web ref. - IMO is more like a judicial enforcement body.

Example sentence(s):
  • Execution (post-judgment) creditor: one who, having recovered a judgment against the debtor for his debt or claim, has also caused an execution to be issued thereon.

disagree  Silvia Marinucci: This document is not about "esecuzione forzata", it is about PIGNORAMENTO (foreclosure). In Italian law, these two phases are different. The execution you're talikng about is a prerequisite of the foreclosure. I'm afraid you confused these two phases.

  -> Foreclosure of a mortgage - you must know more about the context than me - is execution levied against narrowly specific types of property like land (or chattels in the USA).
