Recipient’s respective obligation of confidentiality contained in this Agreement shall not apply to information that (i) at the time of disclosure was in the public domain or comes into the public domain other than through breach of this Agreement by the Recipient, (ii) was known by the Recipient (as established by Recipient’s own records or other competent proof) before disclosure by Suunto, (iii) is lawfully disclosed to the Recipient by a third party without confidentiality obligation.
For the purposes of the preceding exceptions, any specific disclosure shall not be deemed to be within the foregoing exceptions solely due to the fact that it is embraced by the general disclosures that are in the possession of the Recipient or form part of the public domain. Moreover, any ***combination*** shall not be deemed to be within the foregoing exceptions solely due to the fact that an individual feature of such ***combination*** is in the possession of the Recipient or in the public domain.
