My take: 1. Contractual non-conformance: Failure to meet contractual provisions. This would certainly include dubious forms of conduct, such as awarding fat contracts to your friends. 2. Non-conforming conduct (aka "misconduct") - i.e. cases that are not necessarily breaches of contract. In this sense, these may overlap to a certain extent. I don't think you have to worry about the philosophy of overlapping types of nonconformities.
